EXECUTIVE SUMMARY
Recommend Approval from the Board of County Commissioners to install
Navigational Markers in Outer Clam Bay for USACE permit compliance and
recommendation to move forward with permitting and installation.
OBJECTIVE: Obtain a recommendation of approval from the Board of County
Commissioners to install Navigational Markers in Outer Clam Bay as directed by the
USACE permit and the Clam Bay Advisory Committee. In addition, approval is
recommended to move forward with permitting and installation.
CONSIDERATIONS:
The USACE permit 199602789 issued on 8/11/1998 directed that navigational markers
be installed in Outer Clam Bay in accordance with Special Condition 2 of the permit. In
addition, the Board of County Commissioners directed Staff through the Clam Bay
Advisory Committee to come into compliance with the existing permit conditions as
quickly as possible. Considerable discussion has occurred concerning the need for
navigational markers in Outer Clam Bay. The following information is provided to clarify
the situation:

Letter from USACE dated March 2, 2009 directing that navigational markers are
required in Clam Bay by permit and need to be installed per USCG standards.
Email from Joe Embers of the USCG dated April 14, 2009 indicating that Clam
Bay is a navigational waterway and that aids to navigation installed in Clam Bay
needs to be in accordance with Aids to Navigation Standards.
February 27, 2009 email and pictures from Pamela Keyes addressing USCG
approved navigational buoys.
Collier County Ordinance 96-16 Establishing Clam Bay for Motorized Vessel Use
at idle speed.
City of Naples letter dated February 24, 2009 expressing support for the
installation of navigational markers in Clam Bay.
Quit Claim Deed Ordinance 09-66, Page 1841-1862; Declaration of Restrictions
Ordinance 0966, Page 1830-1831; Department of Army, Permit Ordinance 0966
Page 1824-1829 outlining county restrictions against navigational dredging.
7. Proposed channel marker locations and signage.
The Board of County Commissioners directed staff to come into permit compliance as
quickly as possible. A permit application has been submitted, in advance, to the US
Coast Guard and the Florida Department of Environmental Protection in order to
expedite permit processing and reduce permitting lead time. If the Board disapproves
the permit application, staff will simply remove it from the permitting cue.
ADVISORY COMMITTEE RECOMMENDATIONS: The Permit Sub-Committee of the
Clam Bay Advisory Committee (3-0) and entire Clam Bay Advisory Committee (7-2)
recommended the installation Navigational Markers in Outer Clam Bay. The Coastal
Advisory Committee recommended approval of this item 6-0 on 4/9/2009.

FISCAL IMPACT: Work on this project will be performed by the Coastal Zone
Management staff and the cost will total approximately $13,000. The project will be
funded from the MSTD General Fund (111) and the budgeted transfer from MSTD
General Fund (111) to Pelican Bay Services Division Fund (320) in the amount of
$214,000 will be reduced and sized accordingly prior to year end.
GROWTH MANAGEMENT IMPACT: There is no impact to the Growth Management
Plan related to this action.
LEGAL CONSIDERATIONS: This item has been reviewed and approved by the
County Attorney's Office. This item is not quasi-judicial, and as such ex parte disclosure
is not required. This item requires majority vote only. This item is legally sufficient for
Board action. - CMG
RECOMMENDATION: Recommend Approval from the Board of County
Commissioners to install Navigational Markers in Outer Clam Bay for USACE permit
compliance and recommendation to move forward with permitting and installation and
approve all necessary Budget Amendments.

Gentlemen:
This is in reference to Department of the Army permit number
199602789 issued to you on August 11, 1998. The permit
authorized replacement of Seagate Drive culverts, dredging of the
Clam Pass main channel for Cuts I, 2, 3, and 4, and excavation
and maintenance of interior tidal creeks. The project is located
within Clam Bay and the Gulf of Mexico, in Sections 4, 5, 8, 9,
32, 33, Township 49 south, Range 25 east, Collier County,
Florida.
In accordance with Special Condition 2, the Permittee was to
comply with the components and timeframes specified within the
Clam Bay Restoration Management Plan. It has corne to the U.S.
Army Corps of Engineers' (Corps) attention that the navigational
markers have not yet been installed. Installation of these
markers is indeed a requirement of the Department of the Army
permit. In addition, the markers must meet U.S. Coast Guard
standards for signs. It is requested you provide the Corps with
a drawing showing the placement of these markers and a time frame
when you expect the signs to be in place. This information can
be directed to Ms. Cynthia Ovdenk at our Ft. Myers Regulatory
Office at 1520 Royal Palm Square Boulevard, Suite 310, Fort
Myers, Florida 33919. Should you want to modify any of the
components of the Clam Bay Restoration Management plan, please
directed your request to Ms. Susan Blass, Section Chief, at the
same address.

Waters of the US, See Title 33 Code of Federal Regulations, Subpart 8, 2.36.

Navigation System, See Title 33 Code of Federal Regulations, Part 62.

Based upon a request from the county to install informational and/or regulatory markers, we
would determine the appropriate verbiage to be affixed. The signage however would be 3'x4',
4'x6' or 5'x7', white reflective background, international orange border and geometric symbol
(only if regulatory or danger) and black block characters.

All,
Recent conversations that Pamela from CZM has had with our Regulatory Agencies has discussed the use of buoys to
mark the interior channel for Clam Bay. Please see the attached photo's. We will propose this type of marker to mark
the interior channel and are fairly confident they will be approved if proposed. This meets our goal of the least number
and least visually offensive markers to protect navigation and the environment.
With this in mind, we would propose that the two markers at the mouth of the channel (one on the inside mouth and
one at the outside mouth) be pole markers with informational warning signs attached to them.
Please comment if each of your respective organizations would support this proposal.

authority to adopt this Ordinance to impose idle speed zones on waterways in the unincorporatcd
areas of the County; a'nd
WHEREAS, lhe Coilier County Manatee Prolection Plan, adopted by the Collier County
Board of County Commissioners on t-.1ay 2], 1995, has identified the Clam Bay System as an idle
speed zone, and
WHEREAS, it is neccssary that the speed and operation of vessels located in the Clam
!lay System as specified herein be controlled III order 10 protect manatees and their habitat; and
WHEREAS, the Clam Bay Syslem has been design~ted as a Natural Resource Protection
Area in Collier County; and
WHEREAS, it is in the interest for the safety and welfare of the canoeing public,
J.:ayakers, and small boat operators, tli~t cenain controls and regulations be enacted to reduce risk
and injury 10 the canoeing public, kayakers. and smJII boal operators and ensure the enjoyablilY of
these natural resources by the general public
NOW, THEREFORE, BE IT ORDAr:--''ED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA. that:
SECTION ONE: INTENT AND PURPO.\'E
It is (he intent and purpose of this Ordinance to protect and promote the health, safety and
welfare of the public, induding residents and visitors 10 Collier County and in panicular 10 the
Clam nay area by providing reasonabl<: regulation to the operation of vessels as delined It is
funnel' intended that this ordi"ance shall be liberally construed to cerect such intent and purpose.
SECT/ON TWO: TITLE AND CITATION
This Ordinance shall be known and be cited as the "Clam Bay System Water Safety and
Vessel Control Ordinance."
SECTiON THREE: APPLlCAnll.lTY
This Ordinance shall apply to and be enforced on all (he waters of the following describerl

SECTION FOUR: VESSEl. SPEED RE(jUIA T10N
Except during an emergency or operation by an official of the government while engaged
in official busines~. the operation of any vessel in excesS of idle speed, as delined herein, in or on
any waters of the Clam Bay System is hereby prohibited and is a violation of this Ordinance, Said
prohibition is effective and enforceable provided the *no wake* area is designated by regulatory
marker, signage. buoj. or any other notice of the *no wake" status. The locations of such notices
shall be placed at the discretion o(the County Staff. All such notices posted by the County are
official notices of the County. 11 is no defense to a violation of this Ordinance to allege that the
Defendant did not observe notice of the *no wake* status orlhe waters of the Clam Bay System.
.\'ECTION FIVE: DEFINITIONS
For the purpo~es of this Ordinance, the following words are defined as follows:
A. IDLE SPEED means the minimum speed through or over the surface of the water
lhat will allow the vessc:1 operator to maintain steerage of the vessel.
B. OPERATE means to be in control of the speed of. vessel traveling over or in
water.
C, VESSEL means a motor propelled and/or artificially propelled boat, sailboat.
barge, airboat or other watercrafl used or capable of being used as a means of transportal ion of
one (I) or more persons over or in the water. whether propelled by wind, propeller, or forcing
flow of water by propeller or impeller, or otherwise. Vessel does not include a canoe, kayak, or
similar small minimum wake type vessels provided the vessel is then being propelled only by
paddle and not by motor, pllmp, or sail. "Vessel" does 110t include seaplane,
SECTION SIX: PENAl.TIES
Each violation of this Ordinance is a civil infraction. If a Citation of Violation is not
contested and is paid in full and on time, the fine shall be Fifty dollars (S50.00) for the first
violation within any six (6) month period, and one hundred dollars ($ 100.00) for a second
violation by the same person within anyone (I) year period. If the fine is not paid in full and on
time, the Court may impose a fine of up 10 five hundred dollars (S500.00) plus court costs and
any other costs and/or fees authorized to be imposed by the Court by Florida Statutes. As an
alternative means of enforcement, violations of this Ordinance may be referred to the Collier
County Code Enforcement Board
SECTION SEVEN: ENFORCEMENT
The provisions of this Ordinance shall be enforced by any member of any duly authorized
law enforcement agency or officers having enforcement jurisdiction in Collier County, Florida.
Civil Citations may be used 10 notify the defendant of allegations of violalions of this Ordinance.
SECTION EIGHT.' CONFLICT AND SEVERAIlIUTY
In the event this Ordinance conflicts with any olher ordinance of Collier County or other
applicable law, the more restrictive shall apply, If any phrase or ponion of the Ordinance is held
invalid or unconslitutional by any court of competent jurisdiction. such portion shall be deemed a
separate, distinct and independent provision and such holding shall not affect the validity of the
remaining portion.

SECTION NINE.' INCLUSiON IN TUE CODE OF I.A~V.S AND ORDINANCES.
The provisions of this Ordinance shall become and be made a pan of the Code of Laws
and Ordinances of Collier County, Florida.. The seclions of lhe Ordinance may be renumbered or
relettered to accomplish such, and the word "ordinance" may be changed 10 "seclion," "anicle, ..
or any other appropriate word.
SECTION TEN.' EFFECTIVE DA TE
This Ordinance shall lake effect upon filing with the Secretary of Slale.

Travel through Clam Pass may be treacherous. Shifting aands, a
strong current, and people fishing and swimming all make navigating
the Pass difficult. The traditional use of this Pass by City of Naples
re.sldantsof the Seagate neighborhood continues even as lnten&if}fing
use of the area has led to an increased resistance to boat passage by
a public that doe. not understand that this is a navigable waterway.

Marking tbe channel and providing signaga will go a long way toward
educat'ng people that this pass Is traversed by powered watercraft.
Further, Outer Clam Bay has Incurred a continual loss of se.grasses
over the last decade or so. The bay once thrived with clams and
oysters, but now only a few relic sites with oysters rem~ln. Its once
cl~ar waters are now murky from suspended sediment, likely the result
of stonnwater runoff as the sUrTounding are. has developed. Marking
the channel will direct boater. away from shallow areas where
sediment on the bottom Is more easily stirred up and ml)(ed Into the
water column, lowering light penetration, keeping seagrasses from
growing, and smothering sh.ellfish.
For these reasons, we think it Is imperative that the County abide by
the US Army Corps of Engineers permit which requires compliance
with tbe terms of the Clam Bay Restoration Management Plan, and In
particular with the term necessitating tbat the channel be marked In
accordance with requirements of the United States Coast Guard. We
also believe that the channel marking can be accomplished and .should
be done with minimal visual impact to this extraordinary estuarine
resource.

Dear Mr. Hoppensteadt:
This letter refers to a request for clarification of a
letter sent May 26, 2009 from the Department of the Army (DA) to
Pelican Bay Services Division (PBSD) on behalf of Pelican Bay
Foundation, Inc. The letters all reference DA permit number
1996-02789 issued on August 11, 1998. The permit authorized
replacement of Seagate Drive Culverts, dredging of the Clam Pass
main channel for Cuts 1, 2, 3, and 4, and excavation and
maintenance of interior tidal creeks. The project is located
within Clam Bay and the Gulf of Mexico, in Sections 4, 5, 8, 9,
32, 33, Township 49 south, Range 25 east, Collier County,
Florida. The U.S. Army Corps of Engineers (Corps) has completed
an evaluation of your response and the information provided to
us by your letter dated June 2, 2009.
You requested we make clear that the navigational signs and
markers, referred to in our letter, were the lateral signs that
denote safe navigation. The Corps previously stated by letter
dated, March 2, 2009, that, "In accordance with Special
Condition 2, the Permittee was to comply with the components and
timeframes specified within the Clam Bay Restoration Managemen~
Plan. It has come to the U.S. Army Corps of Engineers' (Corps)
attention that ~he navigational markers have not yet been
installed. Installation of these markers is indeed a
requirement of the Department of the Army permit. In addition,
the markers must meet U.S. Coast Guard standards for signs." To
further clarify, the Corps included the regional conditions for
Nationwide Permit 1 (NWP-:) in our letter dated, May 26, 2009.
Specifically regional condition #1 states the following: "In
Florida, prior to installation of aids to navigation and other

water dependent informational signs must have the appropriate
authorization required from the U.S. Coast Guard and the 2WC.
(CZM-FL)u. The NWP-l allows for placemen~ of "navigation signsu
in waters that may have been declared "non-navigable" by the
National Oceanic Atmospheric Administration (NO~~) or other
agencies, since the Corps definition of "Navigable watersu is
different than NO.~'s as it is used ~o define the authorities of
the Corps of Engineers. Secondly, the regional conditions in
Florida for NWP-l includes; "water dependant informational
signs" as well as "aids to navigation". Both types of signage
require authorization from the FWC and U.S. Coast Guard (USCG)
and do not require a pre-cons~ruction notification to the Corps.
The Corps regulations define navigability for our program
in 33CFR 329.4; the general definition is "Navigable waters of
~he United States are ~hose waters that are subject ~o ~he ebb
and f~ow of the tide and/or are presently used, or have been
used in the past, or ffiay be susceptible fcr use to t~ansport
i:--,terstate or foreign cO:Cll'te'rc':::. p, deterrrcination of navigability,
once ffiade, applies laterally over ~he entire surface of the
waterbody, and is not extinguished by later 2c~ions or events
which impede or destroy navigable capacity."
This regulation defines the term "navigable waters of the
[Jr.i~ed States" as it is l;sed ;~o def_;l~~ ::1uLhorities of the Corps
of Sr,gineers. I t a Lso prescribes 'che po 1 icy, pract ice and
procedure ~o be ~sed in dete~rrininq tt:e ex~en~ of the
jurisdic:ion of the Corps of Engineers and in answering
inquiries concerning "Kavigable waters of the United States."
This definition does not apply to authorities under the Clean
Water Act which definitions are described under 33 C~~ parts 323
and 323. Sec. 329.5 further discl;sses Lhe general scope of
determi~ation and that several factors ffi~St be examined when
making a determination whether a waterbody is a naviga~l~ water
of Lhe United S~ates, such as ?ast, present, or potentlaL

This definition is used to define authorities of the Corps
of Engineers and does not apply to how other agencies define
"navigable waters" including the USCG and NOAA.
The Corps evaluated a letter dated May 14, 2009 from the
Office of the County Attorney (Collier) stating that the PBSD is
a dependent branch of Collier County and as such is not
authorized to bind the Collier County Board of County
Commissioners (BOCC) with regard to any issues. The Corps has
informed the many forms of Collier County Government and all
other interested parties that they are encouraged to work
together to resolve any disputes. The Corps' position is that
installation of "water dependant informational signs" as well as
"aids to navigation" signage that have been proposed thus far,
in order to come into compliance with the permit as required by
Special Condition 2, would be covered under the NWPl, this
includes canoe trail markers and non-lateral navigation signs.
No further action is required from the Corps.
