Agenda 06/23/2009 Item #10B Agenda Item No. 108 June 23, 2009 Page 1 of 4 EXECUTIVE SUMMARY Recommendation that the Board of County Commissioners of Collier County, Florida, adopt a Resolution amending Resolution No. 2009-101, known as the Collier County Community Development and Environmental Services Fee Schedule, by adding a Paragraph "YY" pertaining to fees for the Mandatory Code Inspection of Foreclosed and Abandoned Homes Ordinance, Ordinance 2009-_. OBJECTIVE: That the Board of County Commissioners (Board) adopt a Resolution amending Resolution No. 2009-101, in order to add a Paragraph "YY" pertaining to fees for the Mandatory Code Inspection of Foreclosed and Abandoned Homes Ordinance. CONSIDERA TIONS: At the May 26, 2009 BCC meeting, under Agenda Item #1 OJ, staff, based on input from several interested organizations and constituents within the community, presented to the Board a proposal whether to implement a mandatory code inspection of vacant and foreclosed residential properties and Certificate of Inspection program, prior to sale, within the unincorporated area of Collier County and to document and disclose to the buyers the extent to which the residential properties (i.e. single-family, condominium, townhouse, or duplex), comply with all applicable building codes and zoning codes, and to seek guidance whether to implement a voluntary or mandatory code inspection of the residential properties prior to sale. At the conclusion of that presentation the Board directed staff to return with an ordinance to implement a mandatory inspection program for abandoned and foreclosed residential properties and to create a process to have the inspections performed by certified inspectors from the private sector. This fee schedule change is companion to two items on the agenda, the item seeking Board approval of the implementing ordinance and the item requesting Board approval of the associated administrative manual and related resolution. PREPARED BY: Joe Schmitt, Administrator, CDES - RESOLUTION NO. 2009 -_ A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, AMENDING RESOLUTION NO. 2009-101, KNOWN AS THE COLLIER COUNTY COMMUNITY DEVELOPMENT AND ENVIRONMENTAL SERVICES FEE SCHEDULE, BY ADDING A PARAGRAPH "YV" PERTAINING TO FEES FOR THE MANDATORY CODE INSPECTION OF FORECLOSED AND ABANDONED HOMES ORDINANCE, ORDINANCE NO. 2009- Agenda Item NO.1 08 June 23, 2009 Page 2 of 4 WHEREAS, on June 23, 2009, the Board of County Commissioners (Board) adopted Ordinance No. 2009-_, entitled the "Mandatory Code Inspection of Foreclosed and Abandoned Homes Ordinance" (the "Ordinance"); and WHEREAS, Section Three of the Ordinance provides that the County Manager is authorized to collect a reasonable filing fee for the administrative costs associated with filing of the Inspection Report and issuance of the Certificate of Inspection, as established in the appropriate fee schedule resolution; and WHEREAS, the Board finds that it is in the government and public interest to amend Resolution No. 2009-101 to include fees associated with implementation of recording and filing procedures associated with the inspection program; and WHEREAS, no other fee as set forth in Resolution No. 2009-101 is being amended by this Resolution. NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that: Resolution No. 2009-101 is hereby amended through the addition of the following Paragraph "YV" pertaining to filing fees for the Mandatory Code Inspection of Foreclosed and Abandoned Homes Ordinance: YV) MANDATORY CODE INSPECTION OF FORECLOSED AND ABANDONED HOMES 1) Disclosure and Findings Report filing fee -- $50.00 PASSED AND DUL Y ADOPTED by the Board of County Commissioners of Collier County, Florida this day of , 2009.
