Agenda 06/09/2009 Item #16C10 Agenda Item No. 16C10 June 9,2009 Page 1 of 11 EXECUTIVE SUMMARY Recommendation to approve a Work Order under Contract 08-5011 "Underground Utilities Contracting Services" in the amount of $573,362.70 to Quality Enterprises USA, Inc.; Projects 73307 and 73972. OBJECTIVE: The public purpose is to structurally restore and enhance the performance of the County's wastewater collection system at Wyndemere and Kings Lake developments by repairing and upgrading the wastewater pumping stations. CONSIDERATIONS: As part of the County's continuing effort to maintain its wastewater pumping stations and to upgrade those stations that are below standards, the County has contracted with Hole Montes for professional engineering services to evaluate the existing pump stations in six different developments as follows: Wyndemere, Lely, Lely Barefoot, Kings Lake, Willoughby Acres, and Riviera Estates. In all, twenty- six (26) pumping stations were evaluated with regard to compliance with County standards, controls and telemetry, general condition, neighborhood concerns, property issues, and odor generation. - The most significant deficiency identified was that each station has only one pump (simplex station), which does not provide the reliability required by current County and State standards. Another deficiency is the lack of telemetry at some stations, thus preventing the County's remote monitoring ofthe station's pump conditions. The Scope of Work under this work order comprises structural, piping and electrical modification to the six (6) existing pump stations in the Wyndemere development and two (2) existing pump stations in the Kings Lake development. This project is consistent with the 2008 Wastewater Master Plan Update as adopted by the Board on June 24, 2008, Agenda Item lOG, and is listed on Table 8-2 page 3 of 5, and line 103 and line 116. The County posted an Invitation to Quote under Fixed Term Contract 08-5011, "Underground Utilities Contracting Services," on May 1, 2009, and distributed it to registered vendors via the Purchasing Department electronic bid process. All vendors under this contract were notified. Five (5) vendors downloaded the solicitation and four (4) quotes were received by the May 15, 2009, deadline. Higgins, Inc. $679,000.00 Mitchell Stark Company, Inc. $1,018,000.00 As describe on the bid tabulation the bids amount include allowance for Florida Power & Light (FPL) costs associated with new electrical service and transformers and allowance for unforeseen conditions and conditions relating to material testing, landscaping, all appurtenances, and maintenance of traffic, paving and restoration. Staff found Quality Enterprises USA, Inc.'s submittal to be the lowest responsive and responsible bid and therefore recommends award. Quality Enterprises quotation is below the Engineer's estimate of probable construction cost and is recommended issuance of the construction contract by the Engineer. Attached for reference is the Evaluation of Quotations letter from the Engineer of Record. The selected contractor has satisfactory performance records on previous projects involving similar work. FISCAL IMP ACT: These funds are available in the FY09 Capital Budget approved by the Board of County Commissioners on September 18, 2008. Funds are budgeted in the Wastewater Department Projects 73307 and 73972 for County Sewer Capital Projects under Fund 414, Wastewater User Fees. LEGAL CONSIDERATIONS: This item has been reviewed and approved by the County Attorney's Office, is not quasi-judicial and requires no ex parte disclosure, requires only a majority vote for approval, and is otherwise legally sufficient for Board action.-SRT GROWTH MANAGEMENT IMPACT: This project meets current Growth Management Plan standards to ensure the adequacy and availability of viable public sanitary sewers and pump stations. RECOMMENDA TION: That the Board of County Commissioners, as the Ex-Officio Governing Board of the Collier County Water-Sewer District, approve a Work Order under Contract 08-5011 "Underground Utilities Contracting Services" in the amount of $573,362.70 to Quality Enterprises USA, Inc. to complete the rehabilitation of pump stations in Wyndemere and Kings Lake developments; Projects 73307 and 73972, and authorize its Chair to execute the work order. An electronic summary of the quotations as received from the County was used for our review. The low quotation was approximately 13% lower than the second quotation and 23% below the third quotation. However, we note this project contains significant complexity so a price variation of this magnitude should not be problematic unless the low contractor expresses concern. Quality Enterprises USA, Inc. submitted the lowest quotation of $458,362.70 excluding two fixed price contingency items totaling $115,000.00. The Engineer's estimate of probable construction cost was $500,000 exclusive of contingency bid items. Quality Enterprises has constructed and successfully completed many County projects, and we understand they are an acceptable utility contractor on the County annual contract list. Hole Montes recommends issuance of the construction contract to Quality Enterprises for the total amount of$573,362.70. Please contact Ron Benson or me if you have any questions or concerns.
