Recommendation to award Bid #09-5241 for construction of Lely Area Stormwater
Improvement Project (LASIP) Mitigation Park Restoration Project No. 60084.1, to
EarthBalance in the amount of $60,053.00, plus a ten percent contingency.
OBJECTIVE: To receive Board of County Commissioners approval for the award of a contract
to proceed with the LASIP Mitigation Park Restoration Project in the amount of $60,053.00 per
plans and specifications to the lowest, qualified and responsive bidder, EarthBalance.
CONSIDERATIONS: In 2004, Collier County received a Florida Communities Trust (FCT)
grant for land acquisition reimbursement for the area known as the Lely Area Storm water
Improvement Mitigation Park. The Mitigation Park is approximately 103 acres in size and
serves as the regional LASIP project's mitigation area. The grant requires restoration of the
disturbed wetland area to be replanted with Florida native species. Invasive exotic vegetation is
also required to be removed. In addition to the FCT requirements, South Florida Water
Management District (SFWMD) and U.S. Army Corps of Engineers (COE) require the
enhancement of two adjacent parcels totaling over one hundred acres as mitigation for impacts
associated with the construction of the Le1y Area Stormwater Improvement Project (LASIP).

The bid was advertised on May 1, 2009, on the Collier County web site. On May 8, 2009, a
mandatory pre-bid meeting and site visit were held to explain the contract specifications and
answer any questions that the prospective bidders may have. On May 20, 2009, twelve (12) bids
were received and two (2) were deemed non-responsive. The submittals were reviewed by the
Stormwater Management Section's staff and the Project's Design Professional in conjunction
with the Purchasing Department. Responses were received from the following firms:

The ten (10) responsive bids received ranged from $60,053.00 to $210,575.83. Although Lake
& Wetland Management submitted the lowest bid, EarthBalance included the Affidavit for
Claiming Status as a local vendor. EarthBalance was provided the "right to match" opportunity
and complied with all requirements, including accepting the lowest bidder's unit prices.

The project estimate was $250,000.00. Staff has reviewed the bids received and recommends
awarding the construction contract to EarthBalance as the lowest, qualified and responsive
bidder.
FISCAL IMPACT: Funds in the amount of $66,058.30 (total construction amount of
$60,053.00 plus a ten percent contingency amount of $6,005.30 for unforeseen related expenses)
are currently available in the Gas Tax Capital Fund 313, Project No. 60084.1.
LEGAL CONSIDERATIONS: This item has been reviewed and approved by the County
Attorney's Office, is not quasi-judicial and requires no ex parte disclosure, requires only a
majority vote for approval, and is otherwise legally sufficient for Board action.-SRT
GROWTH MANAGEMENT IMP ACT: The project is in accordance with the goals and
objectives of the Drainage Sub-element of the Growth Management Plan for Collier County
Stormwater Management.
RECOMMENDA TION: That the Board of County Commissioners:
(1) Approve award of Bid No. 09-5241 to EarthBalance, for the LASIP Mitigation Park
Restoration Project, Project No. 60084.1 for $60,053.00, plus a ten percent (l0%)
contingency ($6,005.30) totaling $66,058.30;
(2) Authorize the Chair to execute, subject to final review and approval by the County
Attorney's Office for legal sufficiency, the standard Board approved contract after
execution by the vendor.
