EXECUTIVE SUMMARY
Recommendation to approve a budget amendment in the amount of $108,719,05 for
Traffic Accident Reimbursements, Fund 112 Project #60076.1, and to recognize
revenues for future repairs"
OBJECTIVE: Approve a budget amendment in the amount of $108,719.05 for traffic
accident reimbursement and incidental repairs in Landscape Project Fund (112), Project
#60076.1 (Traffic Accidents and Turn Lanes) and to recognize revenues for future repairs
in operating expense line (634999).
CONSIDERATIONS: The Alternative Transportation Modes Department has accepted
a settlement check in the lawsuit entitled Collier County Florida VS. Botner Land Design,
Inc., Case No. 02-1923-CA, which was pending in the Circuit Court in Collier County,
Florida, in the amount of $99,500.00. The Board of County Commissioners previously
approved that settlement on March 10, 2009, Item 16-K2. Also, staff has coordinated
with the Risk Management Department to collect reimbursements for damages due to
traffic accidents occurring on our landscaped medians that total $9,219.05; therefore, the
total amount sought to be recognized is $108,719.05. By recognizing these revenues,
repairs can be made to replace damaged plant material and broken irrigation components.
The accident/incident repairs are made during the off-season months not to impede the
traffic flow.
FISCAL IMPACT: A budget amendment is needed to recognize $108,719.05 in the
Landscape Fund (112) Project #60076.1 (Traffic Accidents, Turn Lanes, and other
Revenues) and appropriate within the landscape operating expense line 634999.
LEGAL CONSIDERATIONS: This item has been reviewed and approved by the
County Attorney's Office, is not quasi-judicial and requires no ex parte disclosure,
requires only a majority vote for approval, and is otherwise legally sufficient for Board
action.-SRT
GROWTH MANAGEMENT IMP ACT: There IS no growth management impact
associated with this Executive Summary.
RECOMMENDATION: That the Board of County Commissioners approve a budget
amendment to recognize revenue from Landscape Fund (112), Project #60076.1 (Traffic
Accidents, Turn Lanes and other Revenues) and appropriate to the landscaping operating
expense line (634999).
