EXECUTIVE SUMMARY
Recommendation to approve a Second Amendment to Agreement for Legal Services for the
Retention Agreement with Henderson, Franklin, Starnes & Holt, P.A.
OBJECTIVE: To continue retaining as outside counsel the law firm of Henderson, Franklin,
Starnes & Holt, P.A.
CONSIDERATIONS: On December 11, 2012, the County and Counsel entered into an
Agreement (the “Agreement”) wherein the County agreed to retain Counsel to provide
specialized legal services. Following several renewal terms, the Agreement is scheduled to
shortly expire. The proposed Second Amendment extends the term of the Agreement to
September 12, 2021, includes three 1-year renewal options, reflects changes of members in the
firm, and adjusts fees.
FISCAL IMPACT: None.
GROWTH MANAGEMENT IMPACT: None.
LEGAL CONSIDERATIONS: The proposed Second Amendment was reviewed for form and
legality by the County Attorney and requires a majority vote for approval. -JAK
RECOMMENDATION: That the Board of County Commissioners (Board) approves and
authorizes its Chairman to sign an Amendment to Agreement for Legal Services relating to the
Retention Agreement with the law firm of Henderson, Franklin, Starnes & Holt, P.A.
