Agenda 06/11/2019 Item #16C 9 (2nd Amendment - Hometown Landmark Lease)06/11/2019 EXECUTIVE SUMMARY Recommendation to approve a Second Amendment to Lease Agreement with Hometown Landmark, LLC, for the continued use of County-owned vacant property. OBJECTIVE: To allow Hometown Landmark, LLC, to continue to lease vacant County-owned property in North Naples. CONSIDERATIONS: Since 1989, Hometown Landmark, LLC (Hometown), a mobile home community in North Naples, has leased a portion of County-owned property near the intersection of U.S. 41 and Old 41, measuring approximately 75’ x 265’ (Property). The Property is used by the residents of Hometown as storage for RVs, campers, and trucks. The purpose of the Amendment is to extend the lease term to August 14, 2020, with automatic one -year renewals, to reduce the annual rent increase from five percent to three percent, and to restate the requirement for payment of sales tax based on the lease rate. The rental increase rate was initially established in 1989 and is now being decreased to reflect the current standard increase included in ot her County leases. The First Amendment to Lease Agreement includes an early termination provision that will stay in effect that allows either party to terminate at any time by providing ninety-days written notice. FISCAL IMPACT: The annual rent, for the first year of the extended lease term, of Three Thousand Nine Hundred Ninety-Four Dollars and Sixty-Seven Cents ($3,994.67) will be paid in full and shall be deposited into: 313-163673-362180 (WBS element 31313.1). GROWTH MANAGEMENT IMPACT: There is no impact to the Growth Management Plan. LEGAL CONSIDERATIONS: This item is approved for form and legality and requires majority vote for Board action. - JAB RECOMMENDATION: To approve and authorize the Chairman to execute the Second Amendment to Lease Agreement with Hometown Landmark, LLC.
