Agenda 06/11/2019 Item #11C (Rezoning C-5/GTMUD)06/11/2019 EXECUTIVE SUMMARY Recommendation to evaluate the options for the rezoning of lot 11 from Residential Multi-Family Six (RMF-6) to Heavy Commercial/Gateway Triangle Mixed Use District (C-5/GTMUD) as requested at the April 23, 2019, public hearing under agenda item 6, Public Petition request from Michael Tirpak and provide direction on the options provided. (Mike Bosi, Director, Zoning Division) OBJECTIVE: To provide options for the rezoning of lot 11 on Terrace Avenue, currently within a RMF- 6 zoning district, based upon direction provided to Staff at the April 23, 2019 Public Hearing. CONSIDERATIONS: At the April 23, 2019 public hearing, in response to a public petition by Michael Tirpak, requesting assistance from the Board of County Commissioners (Boa rd) to waive fees and the procedural process for rezoning a portion of his parcel that is zoned RMF-6 to C-5, the Board directed staff to bring back an Executive Summary identifying the options for Mr. Tirpak. The lots in question are officially owed by MJ & PA Tirpak Living Trust. Within the public petition request, Mr. Tirpak requested the Board to retroactively change the zoning on Lot 11 from residential to commercial, but this option is not available. Additionally, the change in zoning to lot 11 from RMF-6 to C-5 will require an amendment to the Growth Management Plan (GMP). The rezoning process and the Future Land Use Map designation change both must adhere to the proper procedural due process steps and therefore cannot be done legally without satisfying the public process provided for within the GMP and LDC. Based upon this recognition, Staff has identified several options below for the Board to consider addressing the issues presented by Mr. Tirpak. The history of the parcel is provided for within Attachment “A” of this executive summary. As noted in the write-up, staff could not verify if the claims of unauthorized zoning of lot 12 to commercial from residential in 1973 can be substantiated, but what can be verified is that the eastern most three of the four parcels owned by MJ & PA Tirpak Living Trust are within the Commercial-Five zoning district, with the fourth (lot 11) zoned Residential Multi-Family Six. That lot 11 and 12 were undeveloped and vegetated from 1995 to 1999. That lots 11 and 12 were cleared between 1999 and 2004 and the commercial activity of auto storage on lots 11 and 12, per the aerial photos, coincide with the Tirpak’s acquisition of the property in 2006. Additional within Attachement “B” is an e-mail correspondence from the County’s Hearing Examiner to Mr. Tirpak providing for various options for the property based upon his research of the facts. It should be noted that the date of the e-mail is February 6th of this year, two months prior to the public petition request. The traditional option for such a situation would be for the property owner to file a petition to amend the Growth Management Plan (GMP) and rezone the properties to the Heavy Commercial District(C-5), which would provide for C-5 zoning designation for all of the lots under ownership of Mr. Tirpak, then submit an Site Improvement Plan (SIP). The GMP amendment and rezoning process is a well-established process and required to be satisfied when a property owner is seeking an alternative use than what thei r current future land use designation and zoning provides. The cost is born by the property owner, and the benefit of the GMP amendment and rezoning process is received by the property owner. A second option would be for the Board to direct staff to waive the application fee for the GMP amendment and rezoning but require Mr. Tirpak to satisfy the cost of advertising associated with the petitions. This would reduce the fiscal obligation of Mr. Tirpak by approximately $15,750. This option would obligate Mr. Tirpak to provide for consultant fees, , SIP application fee, as well as advertising cost. 11.C Packet Pg. 308 06/11/2019 A third option would be for the Board to direct staff to waive the application fee for the GMP amendment and rezoning, as well as the cost of advertising associated with the petitions. This would reduce the fiscal obligation of Mr. Tirpak by approximately $18,250. This option would obligate Mr. Tirpak to provide for a SIP application fee and consultant fees. A fourth option would be for the Board to direct staff to initiate the GMP amendment process and rezoning process as Staff initiated companion petitions, develop the required application materials and satisfy the required Neighborhood Information Meetings, as well as the CCPC and BCC meetings. This option would alleviate Mr. Tirpak from any financial obligation associated with the rezoning and GMP process, only obligating Mr. Tirpak to the cost associated with the SIP $6,950. It should be noted that any of the four options identified above would still require Mr. Tirpak at the completion of each process to submit a Site Improvement Plan to satisfy the LDC requirements of bringing lots 11 and 12 within the design requirements of commercial property, which includes stormwater management, setbacks, landscaping buffering and in this instance providing a code required wall to screen the residential properties to the west of the commercial activity. The existing commercial activity on lot 12 was never permitted through the proper zoning authorizations, and even with the proper zoning designation of both lots, an additional step would be required to bring the site into conformity. Finally, a fifth option would be for the Board to take no action related to the GMP -amendment and rezoning process and direct staff to work with Mr. Tirpak to legally incorporate lot 12 within the commercial activity of his existing business operations. There would be fiscal obligations associated with the Site Improvement Plan that Mr. Tirpak would have to satisfy, but those would be much reduced compared to the fees associated with the land use changes. It should be noted that lot 11 would not be able to be utilized for commercial purposes. Lot 11 could be utilized as a buffer from the commercial operation to the residential properties to the west; or Mr. Tirpak could split the lot from his parcel and make the lot available for sale. FISCAL IMPACT: There is no fiscal impact associated with option one or five, the traditional rezoning process or submittal of a Site Improvement Plan, as application fees are designed to cover the cost associated with staff review time. There would be a fiscal impact associated with options two, three and four to satisfy the GMP amendment and rezoning application cost, advertising cost, as well as Staff’s time to prepare an application, hold a neighborhood information meeting and attend all required public hearings, as well as coordination with the DEO. GROWTH MANAGEMENT PLAN (GMP) IMPACT: There are no anticipated impacts to the GMP, as each of the options identified are consistent with the Future Land Use Element (FLUE) of the GMP. LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, is approved as to form and legality, and requires majority vote for approval. -HFAC RECOMMENDATION: That the Board of County Commissioners evaluate the options identified by Staff and provide the direction to move forward with the appropriate option based upon all factors. The Collier County appraiser has it listed on their web site as of today as Use code 70, Vacant Commercial. I also own a developed piece adjacent to it to the east, being 3047 Terrace Ave., Lots 13 & 14, Rock Creek. Which I purchased in 2000. I first became aware of 3023, Lots 11 & 12 when I got a call from James Morande, a car dealer, who had purchased it from Michael P. Valentine in July of 2004. Jim asked me to fence it for him as at the time I was in the fence business next door at3047 TerraceAve. I had known Jirn for a year or so having bought a car from him. I asked what he was going to do with the property and he said "just store some over stock car inventory on it". I got a commercial fence permit and fenced the property. Jim Removed a few trees and stored cars there off and on for a period of time. It wasn't long, a year and a half or so, and Morande got into business trouble and the property went back to Michael Valentine as it was under a Iand contract. The property went back on the market unbeknownst to me and shortly thereafter I was approached by Michael Valentine inquiring if I would be interested in buying it. I said yes, as at the time I had use for it myself for storage of fence materials and some overflow taxi cabs that one of my tenants had next door during the summer slow season, so I purchased the property in February of 2006, assuming it was commercial as shown on the appraisers web site. As time passed the cab company moved out and I leased the property to 3 different towing companies over the period of several years, the last of which is still there. As things changed I started to rent out the front half of the land for motor home and boat storage while the towing companies used the back half. This type activity went on for almost 13 years without a hitch or complaint from anyone. We hacl inspections for several of the businesses housed there, both state, county and police and never a rnention of any violation of any kind. Then on September 7 , 20IB I received a notice of violation. Here is where I guess, in crystal clear hindsight, I wasn't as prudent as I should have been from the start. I assumed and believed a couple of things. One: Was that Jim Morande was telling me the trutlt when he said that he got permission and approvals to store cars on the site. Two: I was lead to believe from the Collier County appraisers web site that the land was Commercial as it was and still is listed that way, and also was told by both Jim Morande and Michael Valentine that it was. When I broLrght the Appraisers web site descriptive listing up to the zoning people they actually said "you should have known that was not right" How would I just know that? Why would I or any other person nor assurre that the county was coordinated in their statistics and information on their web sites? The original owner of the property at 3023 Iots 11 & 12 was Duane Lyon. He Bought the property in 1967 as you can see from the attached docs. He owed the property until 2002 when he sold it to Michael P Valentine. Note that this includes 1973. Also in the attached docs. You will see that a fellow named Vernon Duncklee petitioned the county to change the zoning from residential to commercial on lots 12 through 20 and successfully got them changed on 7lll1973. The thing is that Vernon Duncklee NEVER owned lot 12! The brother of Duane Lyon, Dale, still lives next door on Lots 10 & 11. He is BB yrs old and has lived there since 1947. He says that his brother had no idea that Duncklee had changed the zoning on lot 12 and no permission was ever given to do so. The two brothers surmised that Duncklee pulled the wool over the counties eyes so he could build three buildings on a zero lot lines on lots 13 & 14 which he then owned and which he did build on. I had a meeting with several county staff members with my attorney about a two or so months ago. They agreed that probably back in the 60's or 70's the county should have changed the zoning to commercial from Airport Rd. to Shadowlawn on the whole north side of Terrace Ave. They suggested too that maybe I could get the remaining owners down to Shadowlawn to to the west to go in with me on a group zoning change. There are nine property owners that would need to agree, which the first few I contacted had no interest. Another footnote here is that this address which comprises of two 40 ft. Iots is now split in half which pltsVz of the property in the Bayshore Triangle redevelopment area and the other half outside of it! So. What can you do to help me? Here is my quandary. I have looked into getting the zoning changed and complying with today's regulations. Keep in mind that this is just Vzof the parcel,40ft. Wide! In a nut shell it's going to cost me upwards of $100,000.00 or more to change a 40 ft strip of land from RFM-6 to C-5 and "engineer" it to store vehicles! To me that is out of the question and quite unfair as not only was the county duped when Vzof rhe property was re-zoned, but so too was myself. There are many, many outdoor storage areas in this county that are unpaved and fenced to their property lines such as mine. My hope is that since the original zoning change to only ll2 of the property was gotten under folse pretenses, without permission of the owner, that you could help me get the other half changed to C-5 retroactive to 1973 without all of these atrocious fees and associated costs of engineering and walls. Why would the county, even back in 1973, let someone change Vz of. a small addressed residential parcel, that by the way, had a house on it at the time that wos partially encroaching(see survey) on lot 72, from residential to commercial? It was just not right! An injustice was done and no one seems to want to help in rectifying it at Zoning today. Had Mr. Duncklee been turned down or got caught in his trickery I would not be in this situation. -fhe property would still be zoned residential and shown as such on the appraisers web site. I would have never bought it had it shown as residential, as are the residential lots to the west of me! This error on the counties part essentially makes my piece of land utterly worthless. I can't be built on it because of the duel zoning and as I have been told by 3 civil engineers that getting lot 12 changed to C-5 will most likely be impossible because of highly probably objections from one or more neighbors even though it has been used that way for going on 15 years.
