EXECUTIVE SUMMARY
Recommendation To Authorize The County Attorney To File A Lawsuit On Behalf Of The
Collier County Board Of County Commissioners, Against Patricia L. Galloway And
Athena A. Galloway In County Court Small Claims Division In And For Collier County,
Florida, To Recover Damages In The Amount Of $2,616.66.
OBJECTIVE: For the Board of County Commissioners to authorize the County Attorney to file
a lawsuit in the County Court Small Claims Division in and for Collier County, Florida against
Patricia L. Galloway and Athena A. Galloway for damages to a County owned guardrail in the
amount of$2,6l6.66.
CONSIDERATIONS: On February 21, 2008, Athena A. Galloway was operating a vehicle
owned by her mother Patricia L. Galloway with her consent. Athena Galloway was traveling
Westbound on US 41 (SR 90) at or near the intersection of Burns Lake Road in Collier County,
within a properly marked construction zone. The Galloway vehicle negligently struck the
vehicle in front of it, proceeded onto a grassy area striking and damaging a guardrail owned and
maintained by Collier County. The guardrail had to be removed and replaced, at a cost of
$2,616.66. Although contacted on numerous occasions, Patricia L. Galloway and Athena A.
Galloway have failed and/or refused to pay the County's costs incurred. The County has no
other recourse for recovery of the costs than to proceed with litigation.

FISCAL IMP ACT: Funds are budgeted and available in the Risk Management Property &
Casualty Fund.
GROWTH MANAGEMENT IMP ACT: None.
LEGAL CONSIDERATIONS: Both the County Attorney and the Risk Management Director
agree that litigation is the best recourse for recovery of the costs as the negligent parties have
refused to compensate the County for its damages. This item is not quasi-judicial, and as such ex
parte disclosure is not required. This item requires majority vote only. - CMG
RECOMMENDATION: That the Board of County Commissioners authorizes the County
Attorney to file a lawsuit against Patricia L. Galloway and Athena A. Galloway in County Court
Small Claims Division in and for Collier County, Florida, to recover $2,616.66 for costs incurred
as a result of the damages to the County's guardrail and costs of the suit.

STATEMENT OF CLAIM
COMES NOW the Plaintiff, BOARD OF COUNTY COMMISSIONERS, COLLIER
COUNTY, FLORIDA (hereinafter the "COUNTY"), by and through the undersigned attorney,
and files its Complaint against PATRICIA L. GALLOWAY and ATHENA A GALLOWAY,
and states to the Court as follows:
I. This Court has jurisdiction over the parties hereto because all events occurred in
Collier County, Florida, and all parties were present in Collier County, Florida at all times
relevant.
2. On February 21, 2008, ATHENA A GALLOWAY was operating a vehicle
owned by her mother, PATRICIA L. GALLOW A Y, at her mother's direction and control, and
with her mother's knowledge and consent in Collier County, Florida.
3. ATHENA A. GALLOWAY was traveling westbound on US 41 inside a road
construction site which was properly marked_
4. ATHENA A. GALLOW A Y negligently operated her vehicle by failing to yield to
traffic and negligently struck the car in front of her.

5. ATHENA A. GALLOW A Y further negligently drove her vehicle off of the
roadway and struck and damaged the guardrail owned and maintained by Collier County. See
Exhibit A, Florida Traffic Crash Report.
6. On February 21, 2008, at approximately 7:29 a.m.. ATHENA A. GALLOWAY,
as a driver on the public roads, had a duty to exercise due care and caution in the operation of the
vehicle she was driving.
7 . PATRICIA L. GALLOWAY, as oV\'l1er of the vehicle, and in control of her
daughter, in directing her daughter to drive her vehicle, had a duty to see that her vehicle was
operated safely and properly upon the Public Roadways of Collier County, Florida.
8. As a result of the negligence of Defendants, ATHENA A. GALLOWAY and
PATRICIA L. GALLOWAY, the guardrail at that location that was owned and maintained by
the County was severely damaged.
9. Collier County expended $2,616.66 to repalr the damage caused by the
Defendants, See Exhibit B, Invoice for Repairs.
10. Collier County has requested and demanded that each defendant. PATRICIA L.
GALLOWAY and ATHENA A. GALLOW A y, reimburse the County for Defendants'
negligence. Both Defendants have failed and/cr refused to reimburse the County for its expenses
in repairing the damage.
11. The Defendants' conduct and actions, and refusal to compensate the County,
necessitated the filing of this action, the expenditure of costs for this action, as well as substantial
attorneys' fees, by the County.
WHEREFORE, Collier County respectfully requests the Court:

A. Enter a judgment against PATRICIA L. GALLOWAY and ATHENA A.
GALLOWAY, jointly and severally. in the amount of $2,616.66. plus costs of suit, reasonable
attorneys' fees, and interest allowed by law from the date of judgment until paid, for which let
execution issue.
B. Grant such other and further relief as the Court deems just in the circumstances.
