EXECUTIVE SUMMARY
Recommendation to waive the residency requirement for a member of the Immokalee
Beautification MSTU Advisory Committee.
OBJECTIVE: For the Board to waive the residency requirement for a member of the Immokalee
Beautification MSTU Advisory Committee who has moved out of the MSTU boundaries.
CONSIDERATIONS: This five-member committee was created by Ord. No. 85-65, amended by Ord.
Nos. 90-8 and 92-40, to assist the Board of County Commissioners in the business affairs of the
Immokalee Beautification Taxing District, and prepare and recommend an itemized budget to carry out
the business of the district for each fiscal year. Membership represents the population of the area within
the Immokalee Beautification District. Terms are four years. A list of the current membership is attached.
Section 122-1840(b) of the Code of Laws describes the committee membership requirements as follows:
Members of the committee shall be appointed by and serve at the pleasure of the Board of County
Commissioners. Four members shall be permanent residents within the MSTU and electors of Collier
County. One member may be an owner of residential or commercial property within the MSTU or an
appointed representative of a business located within the MSTU and elector of Collier County. An owner
of residential or commercial property may be an individual, an officer of a corporation, or a partner of a
partnership.
Ms. Cherryle Thomas, a committee member since 1988, recently moved out of the Immokalee
Beautification MSTU district to the town of Ave Maria. She has been a member of the committee for over
30 years, and during the past two years has had only two excused absences. Recent attendance records are
attached.
COMMITTEE RECOMMENDATION: The committee requests that the residency requirement for Ms.
Thomas be waived for the remainder of her term, which shall expire on September 23, 2021, allowing her
to remain on the committee. An email from staff conveying this request is included in the backup.
FISCAL IMPACT: None.
GROWTH MANAGEMENT IMPACT: None.
RECOMMENDATION: That the Board of County Commissioners adopts the Committee
Recommendation, and waives the residency requirement for Ms. Cherryle Thomas for the remainder of
her current term.

RESOLUTION NO. 2017— 163
A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF
COLLIER COUNTY, FLORIDA, REAPPOINTING CHERRYLE THOMAS
TO THE IMMOKALEE BEAUTIFICATION ADVISORY COMMITTEE.
WHEREAS, Collier County Ordinance No. 2002-52 established the Immokalee
Beautification Advisory Committee to advise the Board of County Commissioners (Board) on
matters pertaining to the Immokalee Beautification Municipal Service Taxing Unit(MSTU); and
WHEREAS, Ordinance No. 2002-52 provides that the Advisory Committee shall be
composed of five members; four members shall be permanent residents of the MSTU and
electors of Collier County; one member may be an owner of residential or commercial property
within the MSTU or an appointed representative of a business located within the MSTU and
elector of Collier County; and
WHEREAS, there is one vacancy and one expiring seat on this Advisory Committee; and
WHEREAS, the Board previously provided public notice soliciting applications from
interested parties; and
WHEREAS, the Immokalee Beautification Advisory Committee has provided the Board
with its recommendation for reappointment.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that CHERRYLE THOMAS, who is
a permanent resident within the MSTU, is hereby reappointed to the Immokalee Beautification
Advisory Committee to serve a four-year term expiring on September 23, 2021.
THIS RESOLUTION ADOPTED upon majority vote on thisday of September, 2017.
