EXECUTIVE SUMMARY
Recommendation that the Board of County Commissioners approve the
submittal of a Federal Emergency Management Agency Assistance to
Firefighter's Grant application in the amount of $223,000 for the purchase
of a Pumper Tanker for the Ochopee Fire Control District, and authorize
online submittal of the application.
OBJECTIVE: To obtain Board of County Commissioners' approval to submit an
application for a Federal Emergency Management Agency Assistance to
Firefighter's Grant in the amount of $223,000.
CONSIDERATIONS: Ochopee Fire Control District has received this type of
grant from the Federal Emergency Management Agency (FEMA) in past years.
At this time, the District is in dire need of replacing an existing pumper tanker that
is 19 years old and has reached the end of its life expectancy. This vehicle will
be replaced with a 3000 gallon pumper tanker with B foam capabilities. The
pumper tanker will provide water supply for the District for structure fires, vehicle
fires, brush fires and hazardous material incidents. This is an extremely viable
piece of equipment especially because the closest mutual aid for water supply is
up to 55 minutes away. This equipment will increase firefighter safety and
firefighting resources in the District.
FISCAL IMPACT: The total cost of the Pumpel' Tanker is $223,000. This is a
95/5 matching grant split between FEMA and the Ochopee Fire Control District
with FEMA providing 95% of the costs at $211,850. If awarded, the District's
share of 5% in the amount of $11,150 will be funded from Reserves for Capital
Outlay, Ochopee Fire Control District Fund (146). If awarded, a subsequent item
will be brought before the board to accept the grant and approve the necessary
budget amendments.
GROWTH MANAGEMENT IMPACT: There is no growth management impact
associated with this executive summary.
LEGAL CONSIDERATION: This item is not quasi-judicial, and as such ex parte
disclosure is not required. This item requires majority vote only. This item is

The Ochopee Fire Control District has Interlocal agreements for mutual aid with six fire districts and two
municipality's in collier county and provides response to the Department of Interior Bureau of land managment,
U.S. Forestry service, Florida Deparment of Forestry and four Stale land managment agencies. This vehicle will

Project Description
The Ochopee Fire Conlroi District is a dependent Fire District located in Eastern Collier County, Florida
encompassing 1100 square miles of rural County, State, and Federal Lands. There is one City within the
jurisdiction which the District provides service for. Only 1 % of the District has an established water supply
system therefore water tender operations are relied upon for the majority of all calls. These calls include
structure fires, brush fires, aircraft incidents, commercial vehicie fires, and hazardous materials incidents. Last
year 16 Incidents were responded to before the unit was removed from service. Presently the Fire District has
removed its 3000 gallon 19 year old tanker from service due to mechanical and safety concerns. Without the
water tender the operations for the previously mentioned calls are drastically impacted. The loss/lack of a water
tender also adversely affects the Insurance Services rating for needed fire fiow and creates a safely concern for
limited attaCK capabilities on structural fires. The water tender is an integral part of the mutual/auto aid response
to other agencies: Local, State and Federal. The populations of the mutual aid areas affected are 130,000.
65.000 of that population live in the urban interface of the adjoining Districts which rely heavily on water tender
operations. The water tender increases the efficiency of operation by reducing the number of additional engines
needed for water support. This allows engines to remain In service and reduces mutuat aid use. The water
tender is the most eccnomical solution to the water supply problem in our District due to its large response area
and limited manpower. The loss of the water tender has adversely affected our District and tha other Districts
that have come to depend on our mutual aid service. Consequences of not receiving the award ere a loss of
serviceability, reduced fire attack capability, enhanced potential for loss of property and increased safety risk
due to reduced extinguishing ability. The District seeks to remedy this by the grant application process and
acquisition of a new 3000 gallon water tender with Class A and B Foam capabilities. The acquisition of a new
water tender will meet the insurance services water fiow requirements for rural operations and will provide a
safer reliable response vehicle under the present NFPA 1901 standards. It will be capable of initial attack and
carry equipment needed for rural water supply operations as well as basic life support. The projected cost of the
water tender unit is $223,000.
Financial Need
The District has been instructed by the Collier County Manager to contain budget spending for this current fiscal
year (FY2009) due to shortfalls in collected ad valorem taxes. The District had to commit to contain spending for
FY 2009. In order to accomplish this, a position was frozen and has remained vacant all year. Additionally,
several operating costs were cut in order to complete this year with a balanced budget. Due to a significant
decline in property rates and an Increase in the number of foreclosures, ad valorem revenues within the district
are anticipated to fall below budget amounts by as much as 11.4%. The Dlstiict is cov8iing daily operations and
above that, only emergency expenditures are allowed.
Current forecasts are for property values to continue declining beyond FY2010. Furthermore, the district is
already levying its maximum millage (tax) rate, per Ordinance. A projected decline in taxable value of 23.5% in
FY 2010 equates to a 22,5% decline in ad valorem revenue for the upcoming fiscal year, which will begin
October 1, 2009. If this trend were to persist into FY 2011, it could require a reduction in personnel and
subsequently the level of service provided to residents within the district. All new Lease Purchases for vehicles
have been canceled, and the purchase of a new vehicle is out of the question untess it can be justified as an
emergency. The County is encouraging Departments to pursue grants to cover some of their expenses and to

obialn equipment that normally would be impossible to attain during this financial crisis.
Cost-Benefit
The water tender will service a local population of 4,180 but will be available through mutual aid agreements to
service an adjoining population of 245,000. In addition to having a response capability of 3000 gallon of water
the unit wili have foam capability and will be used as a primary response unit on all aircraft Incidents and be first
due to the local airport also for hazardous materials incidents on the interstate. It will carry BLS equipment 10
serve as a primary Bt.S provider In the absence of available engines, The water tender will also provide a water
supply increase for firefighting operations by a factor of four. This vehicle will respond to approximately 45
incidents locally, not including mutual aid requests. The new water tender wiil be more fuel efficient and provide
a safer response for firefighting personnel. The water tender will replace the present response of three additional
engines for water supply. Some of these units travel up to 30 miles for mutual aid response. The grant will also
provide a mechanically sound and safe vehicle for response with the latest NFPA safety requirements and
comply with interoperability in the Region 6 response. The present water tender is out of service and will not be
replaced until a grant is awarded or in three years when the financial status of Collier County improves, which
wouid Jeopardize life and property due to low water source for firefighting in the area. The District is mostly rural
and this type of vehicle is crucial to its daily operations,
Effect on Daily Operations
This grant will increase the potential for a successful outcome in Initial fire attack. It will do so by increasing the
available water supply by a factor of four for the first arriving units. This will increase firefighter safety due to an
availability for higher initial fiow rates and secondary lines for backup and R.I.T. The water tender will also
provide for needed water and foam for initial hazardous materials incidents, tanker incidents, aircraft incidents
which can only be accomplished at this time by mutual aid companies 30 miles from the District. The ability to
have the additional water and foam capability will also reduce the travel time to water supplies on brush fires
providing an onsite water source. Results will be measured by review of incident responses and time frames for
acquisition of secondary water supply and documentation of use,

Relocation Assistance and Real Property Acquisition Policies Act of 1970 (P.L. 91-646)
which provide for fair and equitable treatment of persons displaced or whose property is
acquired as a result of Federal or Federally assisted programs. These requirements apply to
all interest In real property acquired for project purposes regardless of Federal participation in
purchases.
8. Will compiy with provisions of the Hatch Act (5 U.S.C. Sections 1501-1508 and 7324-7328),
which limit the political activities of employees whose principal employment activities are
funded in whole or in part with Federal funds.
9. Will comply, as applicabie, with the provisions of the Davis-Bacon Act (40 U,S.C. Sections
276a to 276a- 7), the Copeland Act (40 U.S.C. Section 276c and 18 U.S.C. Sections 874),
and the Contract Work Hours and Safely Standards Act (40 U,S.C, Sections 327-333),

sources of drinking water under the Safe Drinking Water Act of 1974, as amended, (P.L. 93-
523); and (h) protection of endangered species under the Endangered Species Act of 1973,
as amended, (P.L. 93-205).
12. Will comply with the Wild and Scenic Rivers Act of 1968 (16 U.S.C. Section 1271 et seq.)
related to protecting components or potential components of the national wild and scenic
rivers system.
13, Will assist the awarding agency in assuring compliance with Section 106 of the National
Historic Preservation Act of 1966, as amended (16 U.S.C. 470), EO 11593 (identification and
protection of historic properties). and the Archaeological and Historic Preservation .Act of
1974 (16 U.S.C. 469a-1 et seq.).
14. Will comply with P.L, 93-348 regarding the protection of human subjects involved in research,
development, and related activities supported by this award of assistance.
15. Will comply with the t.aboratory Animal Welfare Act of 1966 (P.L, 89-544, as amended, 7
U.S.C. 2131 et seq.) pertaining to the care, handling, and treatment of warm blooded animals
held for research, teaching, or other activities supported by this award of assistance.
16. Will comply with the Lead-Based Paint Poisoning Prevention Act (42 U.S.C. Section 4801 et
seq.) which prohibits the use of lead based paint in construction or rehabilitation of residence

explanation to this application.
3. Drug-Free Workplace (Grantees other than individuals)
As required by the Drug-Free Workplace Act of 1968, and Implemented at 44CFR Part 17, Subpart F, for
grantees, as defined at 44 CFR part 17, Sections 17.615 and 17.620:
(A) The applicant certifies that it will continue to provide a drug-free workplace by:
(a) Publishing a statement notifying employees that the unlawful manufacture,
distribution, dispensing, possession, or use of a controlled substance is prohibited in
the grantee's workplace and specifying the actions that will be taken against
employees for violation of such prohibition;
(b) Establishing an on-going drug free awareness program to inform employees
about:
(1) The dangers of drug abuse in the workplace;
(2) The grantees policy of maintaining a drug-free workplace;
(3) Any available drug counseling, rehabilitation and employee
assistance programs; and
(4) The penalties that may be imposed upon employees for drug abuse
violations occurring in the workplace;
(e) Making it a requirement that each employee to be engaged in the performance of
the grant to be given a copy of the statement required by paragraph (a);
(d) Notifying the employee in the statement required by paragraph (a) that, as a
condition of employment under the grant, the employee will:
(1) Abide by the terms of the statement and
(2) Notify the employee in writing of his or her conviction for a violation
of a criminal drug statute occurring in the workplace no later than five
calendar days after such conviction.
(e) Notifying the agency, in writing within 10 calendar days after receiving notice
under subparagraph (d)(2) from an employee or otherwise receiving actual notice of
such conviction. Employers of convicted employees must provide notice, including
position title, to the applicable DHS awarding office, i.e. regionel office or DHS office.
(I) Taking one of the following actions, against such an employee, within 30 calendar
days of receiving notice under subparagraph (d)(2), with respect to any employee
who is so convicted:
(1) Taking appropriate personnel action against such an employee, up
to and Including termination, consistent with the requirements of the
Rehabilitation Act of 1973, as amended; or
(2) Requiring such employee to participate satisfactorily in a drug abuse
assistance or rehabilitation program approved for such purposes by a
Federal, State, or local health, law enforcement or other appropriate
agency.
(g) Making a good faith effort to continue to maintain a drug free workplace through
Implementation of paragraphs (a), (b), (c), (d), (e), and (I).
