COLLIER COUNTY SIGN VARIANCE REQUEST SPROUT’S FARMERS MARKET 2224 LOGAN BLVD N, BLDG 7 NATURE OF PETITION 1. A variance is being requested to allow 3 wall signs for a retail business with a front wall length of 164 linear feet instead of the required 200 linear feet, as stated in LDC section 5.06.04F.4. The square footage of this retail business is 29,843sf. The existing wall sign “Sprouts Farmers Market” is 153.75sf. The two additional signs we are proposing in this variance are 18.94sf and 16.06sf, with a combined total of 188.75sf for the three signs. 2. a) Special Circumstances exist at this location in regard to visibility. The retail stores at this location are located several hundred feet from the roadway, which makes identification of the shops from the roadway difficult to see. Also, the architectural design of the building façade creates a disadvantage for the (2) sub copy signs to be placed any closer together in order to meet code. . b) The literal interpretation of the provision of the sign code as it pertains to wall signs deprives the applicant the right to properly advertise their corporate name and standard branding. The existing sign code requires all open area between signs to be counted as part of the overall size of the wall sign. c) The special condition and circumstance we are requesting relief for is due to the sign regulation that allows only one wall sign on the building. In order to meet code, all dead space between the signs must be counted in calculating the square footage of the sign. d) The granting of this variance would allow the business to keep their branding consistent with other locations and inform the general public of their products; therefore, we do not feel this is granting any special privilege to the business. e) The variance, if granted, would be the minimum relief needed so that the tenant may use their standard corporate branding, which incorporates (2) sub copy signs to advertise the general public the products provided at this location. f) The general intent and purpose of the Collier County Sign Code and the Growth Management Plan is to allow signage for each business that is architecturally pleasing to the eye and proportional to its location. The Dolphin Auto Spa has received development approval by means of the County's Site Development Plan (SDP) review process; SDP-PL20160001414, as may be amended from time to time. As per the most current stamped and approved SDP site plan the subject location comprises 2.0 acres and fronts both Collier Boulevard and Riverwood Road. Correspondence accompanying the SDP reveals the Auto Spa is Phase one of a two phase project, details of phase two have not yet been established; an SDP Amendment is required to pursue a second phase. This subject project is limited to the evaluation of a sign Variance request to allow 3 menu board type signs, each measuring 6 feet by 3.5 feet, to provide a listing of available services and pricing to each of three drive thru lanes where only two such signs are presently allowable. The GMP does not address individual Variance requests but focuses on the larger issue of the actual use. Based upon the above analysis, Staff concludes that the proposed use for the subject site is consistent with the Future Land Use Element, although the Variance request is not specifically addressed. STAFF ANALYSIS OF SIGN VARIANCE CRITERIA UNDER LDC SECTION 5.06.08 B.1: a. That special conditions and circumstances exist which are peculiar to the land, structure or building involved and which are not applicable to other lands, structures or buildings in the same district. The applicant argues that three service or stacking lanes are required to accommodate the anticipated volume of customers in such a manner as to avoid causing a back-up of traffic onto the access road. Three menu boards are necessary to allow each lane an unobstructed view of available services and related fees from each lane. Staff agrees that a menu board for each lane is justified. b. That literal interpretation of the provisions of the sign code would deprive the applicant of rights commonly enjoyed by other properties in the same coning district and would work unnecessary and undue hardship on the applicant. The applicant states that limiting the business to two menu boards is unreasonable, unnecessary, and will cause a hardship when it comes to informing and directing customers as vehicular circulation is limited to a single shared access. That the special conditions and circumstances which are peculiar to the land, structure or building do not result from the actions of the applicant. The site is located at the southeast corner of the intersection of Collier Boulevard, a fast- moving arterial road, and Riverwood Road, a local residential street. Because of the roadway classifications access to the subject property has been severally limited to a single access from Collier Boulevard through a common shared -access driveway which for safety and traffic management is as far away from the point of intersection as possible. As a result of the shared -access requirement all vehicle circulation must be accommodated on site and designed to protect the viability of the shared -access driveway serving not only the car wash but also the heavy commercial uses of abutting properties. The design solution to said access and circulation issues is the three service/stacking lanes for which a menu board is requested to accommodate each lane. d. That granting the Variance requested will not confer on the applicant any special privilege that is denied by this sign code to other lands, structures or buildings in the same zoning district. A Variance by definition confers some dimensional relief from the zoning regulations specific to a site. The appearance and public awareness of the subject Variance request will certainly not be readily known as the three service/stacking lanes are immediately behind and screened from public view by a six-foot concrete decorative wall. e. That the Variance granted is the minimum relief that will make possible the reasonable use of the land, building or structure. Being as a third menu board is required to accommodate patrons in each of three service/stacking lanes, the subject variance request for a third menu board is the minimum relief that will make possible the reasonable use of the land, building or structure. E That the granting of the Variance will be consistent with the general intent and purpose of the Collier County Sign Code and the Growth Management Plan, and will not be injurious to adjacent properties or otherwise detrimental to the public welfare. Section 5.06.01.A. of the LDC states that the purpose and intent of the sign code is to provide minimum control of signs necessary to promote the health, safety and general welfare of the citizens of Collier County, Florida, by: 1. Lessening hazards to pedestrians and vehicular traffic; 2. Preserving property values; 3. Preventing unsightly and detrimental signs that detract from the aesthetic appeal of the county and lead to economic decline and blight; 4. Preventing signs from reaching such excessive size and numbers that they obscure one another to the detriment of the county; 5 Assuring good and attractive design that will strengthen the county's appearance and economic base, and; 6. Preserving the right of free speech and expression in the display of signs. Responses to sign variance criteria 5.06.08 B.1 at a. Special conditions and circumstances exist which are peculiar to the site development and traffic circulation layout which are not applicable to other sites andbuildings in the same district. In order to accommodate the back-up of vehicles on the site waiting to enter the car wash facility, three back-up lanes have been determined to be practical and necessary so cars do not back on to, and block the common driveway access off of Collier Blvd. or on to the abutting commercial properties. Each of the three back up lanes requires a menu board to inform the customer of the car wash services available and the corresponding cost. With only two menu boards being allowed by the code, the drivers of vehicles in the third back-up lane will not always be able to see the critical information posted on the two boards because high profile vehicles will obstruct the view. b. The /iteral interpretation of the sign code pro visions would deprive the applicant of rights commonly enjoyed by other properties and work an unnecessary and undue hardship on saidapplicant, As stated above, the back-up lanes must contain all waiting vehicles on the property. Three lanes have been determined to accommodate said back-up. Limiting a menu board to only two of the three lanes will be unreasonable, unnecessary and cause a hardship when it comes to reasonably informing and directing all customers accessing the site and seeking said service. Generally, two back-up lanes are provided for in fast food uses but because of a limited site with only a single and shared access, vehicular circulation for this car wash facility is physically limited. c. The special conditions and circumstances peculiar to this site do not result from the actions of the applicant. The site is located at the SE corner of the intersection of fast-moving Collier Blvd. which is an arterial road, and Riverwood Rd. a local residential street. Because of the classification of these two roadways, the access to this property has been severally limited to a single access from Collier Blvd. through a common shared -access driveway which for safety reasons and traffic management, is as far away from said intersection as possible. Because of this limited shared -access requirement, all vehicular circulation has to be accommodated on site and designed to protect the viability of the single shared -access driveway to, not only the car wash use, but also to the heavy commercial uses of the abutting properties. The granting of the variance requested will not confer upon the applicant any special privilege denied by this sign code to other sites in the same zoning district. The appearance and public awareness of a special privilege being granted to the applicant will certainly not be readily known because the three back-up lanes are immediately behind and totally screened from public view by a six-foot concrete decorative wall. This decorative wall is yet another site amenity or structure required because of the limiting site conditions that are unique to this physical location, the same limiting conditions not imposed on other commercial properties in the same district. The third menu board provides reasonable use of this unique property. e. The variance, if granted is the minimum relief that will make possible the reasonable use of the land. Only one additional menu board sign is required to provide adequate directions to all users of the site and provide reasonable use of the property. f. Granting of the variance is consistent with the general intent and purpose of the Collier County Sign Code and the Growth Management Plan and will not be injurious to adjacent properties or otherwise detrimental to the public welfare. The variance, if approved, complies with Sec 5.06.01. A. Purpose and Intent. as it will be the minimum control of signs necessary to promote the health, safety and general welfare of the citizens of Collier County. The GMp does not address individual NUA requests but deals with the larger issue of the actual use. As previously noted, the petitioner seeks an NUA pursuant to LDC Section 9.03.03.8 to reduce the westem setback from 7.5 feet to 7.48 feet and the eastern side yard setback from 7.5 feet to 7.22 feet for the existing structure and proposed structure expansion. The subject use is consistent with the FLUM of the GMP. The requested NUA does not have any impact on this property's consistency with the County's GMP. The single-family residence at l l l8 Illinois Dr is situated on a+/- 0.23-acre lot, which is typical for the Gulf Acres neighborhood. The residence was constructed in 1978 under building permit number 78- 2656 and received a certificate of occupancy on November 22, 1978. A survey ofthe residence showed that the existing structure encroached on the east side yard setback by 0.28 feetl3.36 inches (or 3.7%o) and by 0.02 feetl0.24 inches (or 0.3%) on the west side yard setback. (see Survey Markup Attachment A) The petitioner proposes to extend the structure where the existing setback encroachments are located. To avoid offsetting the wall by the non-conforming setback, the petitioner is requesting to maintain the existing nonconformity. Such addition will not firther encroach upon the non-conforming side yard setbacks. Allowing the minor non- conforming setback to continue preserves the sightline for the homeowner and the neighbor, making the addition and existing parts of the structure appear more uniform. It shall be further noted that the front and rear yards have minimum required 25-foot setbacks. The proposed building extensions show compliance with these setbacks. (See Survey Markup, Attachment A). Letters of No Objections were submitted by the neighboring property owners immediately adjacent to the east and west ofthe subject property. (See Attachment B - Application and Support Materiat) The decision to grant an NUA is based on the criteria in LDC Section 9.03.03.B.5.a through f. (in bold font below). Staff has analyzed this petition relative to these provisions and offers the following responses: The alteration, expansion, or replacement will not increase the density of the parcel or lot on which the nonconforming single-family dwelling, duplex, or mobile home is located. The alteration, expansion, or replacement will not exceed the building height requirements of the district most closely associated with the subject nonconforming use. The building height in the RSF-4 District is 35 feet for principal structures; no departure from the height is being requested or recommended for approval, thus the building height requirements will not be exceeded. The alteration, expansion, or replacement will not further encroach upon any nonconforming setback. This petition, if approval is granted as recommended by staff, will not allow any further encroachment because stafls condition specifies that approval is limited to that which is depicted on the survey markup "Record Survey - drawn 7-31-17," prepared by Coastat Engineering Consultants Inc. as shown in Attachment A. The alteration, expansion, or replacement will not decrease or further decrease the existing parking areas for the structure. The residence was constructed in 1978 under buitding permit number 1978- 2656 and received the CO on'lll22ll97 8. A survey ofthe residence showed that the existing structure encroached on the east side yard setback by 0.28 feefl3.36 inches (or 3.7Yo) and by 0.02 feetl0.24 inches (or 0.3%o) on the west side yard setback. Now the homeowner proposes to extend the structure where the existing setback encroachments are located. To avoid offsetting the wall by the non-conforming setback, we are requesting to maintain the existing nonconformity. Such addition will not fu(her encroach upon the non-conforming side yard setbacks. Allowing the minor non-conforming setback to continue preserves the sightline for the homeowner and the neighbor, making the addition and existing parts ofthe structure appear more uniform. To address the specific criteria requested on the NUA application see below: I . The alteration, expansion, or replacement will not increase the density of the parcel or lot on which the nonconforming single-family dwelling, duplex, or mobile home is located; Response: We plan to enlarge the single-famity home, but it witl still be (1) single family home. The density on the lot will not increase. See attached Site Plan. 2. The alteration, expansion, or replacement will not exceed the building height requirements ofthe district most closely associated with the subject nonconforming use; Response: The proposed roof line will match the existing roofline of the one-story structure which is well below the 35 ft max height limit. 3. The alteration, expansion, or replacement will not further encroach upon any nonconforming setbacki Response: We proposed to maintain the current nonconformities, but not encroach further upon either side yard setback. 4. The alteration, expansion, or replacement will not will not decrease or further decreasE the existing parking areas for the structure; Response: The proposed additional along the east property line does not affect the driveway/parking area. 5. The alteration, expansion, or replacement will not damage the character or quality of the neighborhood in which it is located or hinder the proper future development ofthe surrounding properties; and Response: Allowing the proposed wall to continue along the same line as the existing wall will preserve a continuous wall section ofthe structure. This will not damage the character or quality ofthe Neighborhood in which it is located. The alteration, expansion, or replacement will not present a threat to the health, safety, or welfare of the community or its residents.
