Agenda 04/28/2009 Item #16A 2 Agenda Item No. 16A2 April 28, 2009 Page 1 of 49 EXECUTIVE SUMMARY Recommendation to adopt a Resolution amending the Collier County Administrative Code Fee Schedule of development-related review and processing fees as provided for in The Code of Laws and Ordinances, Section 2-11 OBJECTIVE: To have the Board of County Commissioners (BCC) approve a resolution amending the Collier County Administrative Code Fee Schedule of development-related review and processing fees as provided for in The Code of Laws and Ordinances, Section 2-11. CONSIDERATION: The vast majority of operations within the Collier County Community Development and Environmental Services Division (CDES) are funded by fees in the core service areas of building permits, building inspections, site plan reviews, and subdivision reviews. This proposal to amend the fee schedule does not raise the level of any existing building or land use related fee, but in those areas instead encompasses a variety of fee clarifications, fees for activities newly enacted in the LDC or Florida Statute, optional fees for expedited service, and creates lower fees for narrower sections of existing fee covered activities that require less work. Included with this Executive Summary are: Attachment "A"- the Resolution, Attachment "B"- the revised CDES Fee Schedule, Attachment "C"- CDES Fee Schedule Strike-Through and Underlines, Attachment "D"- Specific Fee Language Side by Side. Also included in a separate attachment to the fee schedule is the February 2007 Construction Valuation Table referenced by the Fee Schedule. The changes in this update are all minor in nature related to general housekeeping of the fee schedule and/or the addition of new fees related to recent code changes or optional fees related to the permitting process. The following overview of the fee changes correspond to the numbering sequence on Attachment "D", the fee side by side, and follows the actual order of changes on the full fee schedule attachments. a. b. c. d. e. f. g. h. ~ 1. J. Changes number I (sec A.2) and number 2 (sec C.8.c) are deletions of fees that are redundant or no longer applicable. Change number 3 (sec FA.b) creates a fee for new LDC section 5.05.12, which is related to utility system facilities. Change numbers 4,5, and 6 (sec F.14, F.15, F.16) creates fees for new LDC sections 10.02.04 BA, 10.02.03 BA.b.i, and 9.03.07. Fee Schedule change number 7 (sec H.l) clarifies existing language. Change number 8 (sec K.8) creates a re-submittal fee consistent with other sections and a minor fee for Statute allowed extensions, versus a full submittal fee. Change number 9 (see K.15) creates a consistent re-submittal fee. Change 10 (sec K.21) creates a notification fee consistent with other sections of the fee schedule, and is reflective of actual production and mailing costs. Fee Schedule change number II (sec K.30) is lanb'1lage revision for clarification. Change 12 (sec K.33.a) creates a fee for new LDC section 2.03.07 N.5. Fee Schedule change number 14 (LA) increases the fee for lien searches and related activities from $5 to $25, reflective of the actual costs incurred in this Fund III activity. I. Change 15 (sec L.12) is a language revision for clarification. m. Change 16 (sec L.l6 and L.18.e) is a removal of redundant fee sections. n. Fee schedule change number 17 (sec L.25) creates a small fee for Statute allowed time extensions. o. Change 18 (sec V.l) removes subsection 1 of Screen Enclosure fees, which is redundant with subsection 2. p. Change number 19 (sec TT) allows for the recovery of actual costs for this Fund 111 function. q. Change 20 creates an optional Temporary Certificate of Occupancy fee to cover the costs of research and processing of this expedited process. These proposed fee changes were reviewed by the Development Services Advisory Committee (DSAC) at their April 1,2009 meeting. By a vote of 13-0, DSAC recOlmnended that these fees be approved with the recommendation that the following 3 proposed fces be clarified: a. Change number 3 (sec FA). During discussions, it was asked if this fee was in addition to the Site Development Plan Insubstantial Change fee. An LDC amendment was approved to allow the utility system facilities to be submitted under the SDPl process in lieu of the more costly SDP amendment process. The utilities SDPl is more complex and takes longer to revicw than a normal SDPI consequently it warrants slightly higher revicw fee, a normal SDPI would be processed under (sec. FAa), and an SDPI under Public Utility Systems would be processed under (sec. FAb). b. Change number 9 (sec K.15). Additional language was added to this proposed change to exclude minor revisions as required by staff. c. Change number 17 (sec. L.25). It was asked if the Time Extension Fee was duplication to the SOP Extension fee (sec F.15). This change provides staff the opportunity to charge for services provided when processing extensions where the code allows for development orders or pennits not specifically defined in this fee schedule. This fee is for any time extensions allowed by LDC where there currently is not a fee associated with an extension request. The fee is the same amount for time extensions request for SOP and Final Plats. FISCAL IMPACT: This Executive Summary does not require, nor request, any increase in the current allocation of CDES operating or personnel expenses already approved by the BCC. The proposed new/revised fees for the recent changes to codes and ordinances as noted below are to cover costs incurred for staff time related to the processing of pennits and enforcement of new codes and regulations approved by the Board. Change 3 - SDPI fee for Public Utility Systems accessory uses. Applicant will have to undergo the more costly full SDP amendment process until this fee is approved and implemented. Agenda Item No. 16A2 April 28. 2009 Page 3 of 49 Change 4 - Town Home SDP review. Applications will be processed under the existing SDP plan review process until this fee is approved and implemented. Change 6 - Post Take Site Plan process approved during a recent amendment to the LDC. Applications for the "Post Take" related to transportation corridor planning process will not be accepted until this fee is approved and implemented. Change 12 - Mixed Use Project deviation fee for process approved by the Board. Applications for the "MUP" deviation process will not be accepted until this fee is approved and implemented. Change 13 - Amplified Sound permit as required by the revised Noise Ordinance. Applications for the "Amplified Sound Permits" related to cnforcement of the Noise Ordinance are not being accepted until this fee is approved and implemented. Change 14 - Lien Search fee, increase to cover actual cost incurred by staff for this process. Lien searches are a service provided to real estate brokers and lending institutions to research if there are any existing eode enforcement liens on identified properties. Staff continues to provide the service as requested and the $20 differential between the existing and proposed fee is currently being passed off to the taxpayer and absorbed by general fund (Fund III) budgeted operations within the Code Enforcement Department. GROWTH MANAGEMENT IMPACT: There are no !,'1'owth management impacts. LEGAL CONSIDERATIONS: This request has been reviewed by the Collier County Attorney's Office, and is legally sufficient for the Board of County Commissioners consideration and approval. This item is not quasi-judicial, and ex parte disclosures are not required. X) CONVENIENCE PERMIT FEES 1) Convenience permits are issued in blocks of 10 each. Only licensed contractors are eligible to purchase convenience permits are limited to the use specified on the permit. X) CONVENIENCE PERMIT FEES 1) Convenience permits are issued in blocks of 10 each.
