EXECUTIVE SUMMARY
Recommendation to approve a Stipulated Final Judgment in the amount of $75,000 for
Parcels 123 and 823 in the lawsuit styled Collier County v. John 1. Yaklich, et. al., Case No. 03-
2259-CA (Golden Gate Parkway Pro.iect No. 60027) (Fiscal Impact $115,825), and approve a
hudget amendment to accommodate payment.
OBJECTIVE: That the Board of County Commissioners approve a Stipulated Final Judgment for
payment of full compensation, for the taking of Parcels 123 and 823 in the lawsuit styled Collier
County v. John J Yaklich, et. aI., Case No. 03-2259-CA (Golden Gate Parkway Project No, 60027),
and approye a budget amendment to accommodate payment.
CONSIDERATIONS: Collier County has condemned ,216 total acre parcels for a perpetual road
right-of-way, drainage and utility easement (Parcels 123 and 823) from Owner Rose Somogyi. The
County's initial appraisal dated November I, 2002, valued the takings at $10,200. The County
offered the Owner $10,200 as the County's statutory offer on March 7, 2003. An updated appraisal,
dated August 23, 2003, shows an increase in the market values totaling $13,200. An Order of
Taking hearing was held on September 12, 2003, and the County deposited the sum of $13,200 in
the Court Registry. The Owner has provided an appraisal report reflecting a total value of $635,480
for the parcels, which includes damages in the amount of$570,680.

The disparity in values reflects the Owner's contention that the taking had eliminated the potential
for conditional commercial use of the property, resulting in a damage claim of over $570,000. The
County had valued the parcel as strictly single family residential. The case was mediated on April
26, 2006, and an impasse reached, Trial preparation began in earnest in 2008, inyolving depositions
of witnesses and experts (planners, appraisers and engineers) for the County and the Owner. The
case was re-mediated just prior to the trial date. The mediated settlement recognizes the fact that
the property sits between a bingo hall on one side and a fitness center on the other, effectively
limiting the potential or desirability for single family residential use. The settlement amount
reflects the higher land value for conditional commercial use,
Staff recommends settlement for compensation to the Owner in the amount of $75,000. Further
negotiations were conducted as to expeli fees and costs and attorneys fees and costs to be calculated
in accordance with Subsections 73.032(6), and 73,092(2) and (3), Florida Statutes, reflecting a
settlement in the amount in excess of the Owner's reverse offer of judgment. Trial counsel
negotiated and staff recommends as reasonable, a combined settlement for attorney's fecs and
expeli fees and costs of $54,025. Sce attached Stipulated Final Judgment. If approyed, the County
will be responsible for the following costs:

judicial and as such, ex-parte disclosure is not required. This item requires only a majority yote. RNZ

Final Judgment as to Parcels 123 and 823 and authorize payment of the funds as stated, and
authorize any necessary budget amendment to accommodate payment of the funds.

THIS CAUSE having come before the Court upon Joint Motion made by Petitioner, COLLLIER
COUNTY, FLORIDA, by and through its undersigned counsel, and Respondent, ROSE
SOMOGYI, by and through their undersigned counsel, for entry of a Stipulated Final Judgment as
to Parcels 123 and 823 for Project No. 60027, and it appearing to the Court that the parties are
authorized to make such Motion, the Court finding that the compensation to be paid by Petitioner is
the full compensation due the Respondent, ROSE SOMOGYI, and the Court being otherwise fully
advised in the premises thereof, it is thereupon
ORDERED AND ADJUDGED, that the Joint Motion for Stipulated Final Judgment, attached
hereto, is accepted by this Court; it is further
ORDERED AND ADmDGED that Respondent, ROSE SOMOGYI, haye and recover from
Petitioner, COLLIER COUNTY, FLORIDA, the total sum of Seyenty-Five Thousand and No/lOO
Dollars ($75,000.00) for Parcels 123 and 823, as full payment for the property intcrest taken and for
damages resulting to the remainder, if less than the entire property was taken, and for all other
damages in connection with said parcel; it is further

ORDERED AND ADJUDGED that Petitioner, COLLIER COUNTY, FLORIDA, is entitled
to a credit for the good faith estimate ofyalue previously deposited in the amount of $13.200.00; it

ORDERED AND ADJUDGED that Petitioner, COLLIER COUNTY, FLORIDA, shall pay an
additional Sixty-One Thousand Eight Hundred and Noll 00 Dollars ($61,800.00) to Respondent; it

ORDERED AND ADJUDGED that Petitioner, COLLIER COUNTY, FLORIDA, shall pay an
additional Fifty-Four Thousand Twenty-Five and Noll 00 Dollars ($54,025.00) to Forman, Hanratty
and Montgomery for attorneys fees, expert fees and costs, and no other attorneys fees, expert fees
and costs shall be awarded in this case; it is further
ORDERED AND ADJUDGED that within thirty (30) days hereof, Petitioner shall pay the
total sum One Hundred Fifteen Eight Hundred Twenty-Five No/IOO Dollars ($115,825.00), payable
to: the Forman, Hanratty & Montgomery Trust Account, 723 E. Fort King Street, Ocala, Florida,
34417, for proper disbursement in accordance with this order; it is further
ORDERED AND ADJUDGED that Parcel 123 and 823, being a perpetual, non-exclusive road
right-of-way, drainage and utility easement, being fully described in Exhibit "A" attached hereto
and incorporated herein, which vested in Petitioner pursuant to the Order of Taking dated
September 12, 2003, and the deposit of money heretofore made, is approyed, ratified, and
confirmed; it is further
ORDERED AND ADJUDGED that the Notice of Lis Pendens filed in the above-styled
cause and recorded in Official Record Book 3312, Page 2417 of the Public Records of Collier
County, Florida be dismissed as to Parcels 123 and 823; it is further
