EXECUTIVE SUMMARY
Recommendation that the Board of Collier County Commissioners acting as the governing
body of the Bayshore Beautification Municipal Services Taxing Unit (MSTU) approve a
Resolution accepting the donation of plant materials from American Farms for the
beautification of public rights-of-way within the Bayshore Beautification Municipal Service
Taxing Unit Area.
OBJECTIVE: Recommendation that the Board of Collier County Commissioners acting as the
governing body of the Bayshore Beautification Municipal Services Taxing Unit (MSTU)
approve a Resolution accepting the donation of plant materials from American Farms for the
beautification of public rights-of-way within the Bayshore Beautification Municipal Service
Taxing Unit Area,
CONSIDERATIONS: American Farms would like to donate plants (300, Kalanchoe Landscape
Type 'Veranda' 8 inches in height and 1,002, Euphorbia 'Katies Crovm' 6 inches in height)
valued in the amount of$3,91 0.50 to the Bayshore Beautification Municipal Service Taxing Unit
(MSTU), Pursuant to Section 122-2013 of the Collier County Code of Laws and Ordinances
(County Ordinance #97-82, as amended) providing plantings and maintenance of median strips
within public rights-of-way are within the scope of the MSTU charter. These plantings will be
utilized to beautity the public rights-of~way within the MSTU boundaries.
FISCAL IMPACT: There will be no fiscal impact on the Board's Budget.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney's Office
and is legally sufficient for Board action. Additionally, this item is not quasi-judicial so not ex
parte disclosure is required. A simple majority vote is necessary to approve this item (MMSS).
GROWTH MANAGEMENT IMP ACT: There is no gro\\1h management impact associated
with this item.
RECOMMENDA TION: That the Board of Collier County Commissioners acting as the
governing body of the Bayshore Beaulillcation MSTU accept this donation of plantings from
American Farms and authorize the BCC Chairman to sign the attached Resolution.

RESOLUTION NO. 09-
RESOLUTION BY THE BOARD OF COUNTY COMMISSIONERS OF
COLLIER COUNTY, FLORIDA, AS THE GOVERNING BODY OF THE
BAYSHORE BEAUTIFICATION MUNICIPAL SERVICE TAXING UNIT
(MSTUj, DECLARING A PUBLIC PURPOSE FOR THE RECEIPT OF A
DONATION OF PLANT MATERIAL FROM AMERICAN FARMS FOR THE
BEAUTIFICATION OF MEDIAN STRIPS WITHIN PUBLIC RIGHTS-OF-
WA Y WITHIN THE MSTU BOUNDARIES.
WHEREAS, the Board of County Commissioners of Collier County. Florida (Board). as Governing
Body of the Bayshore Beautification Municipal Service Taxing Unit. wishes to accept donations of plant
material (300 plants-Kalanchoe Landscape Type "Veranda," 8 inches in height and 1002 plants-Euphorbia
"Katies Crown," 6 inches in height) from American Farms for the beautification of public rights-of-way within
the boundaries of the Bayshore Beautification MSTlJ area; and
WHEREAS. the Board Iinds the acceptance of the plant material from American Farms will provide a
public benefit through the provision of aesthetic enhancement of the area; and
WHEREAS, providing plantings and maintenance of median strips within public rights-of-way are in
accordance with the MSTU's charter as set forth in Subsection 122-2013 of the Collier County Code of Laws
and Ordinances (Ordinance Number 97-82. as amended); and
WHEREAS, the Bayshore MSTU Advisory Board voted at its March 11. 2009 meeting to recommend
acceptance of the donation of the plant material valued in the amount of $3.910.50 from American Farms.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS
OF COLLIER COUNTY. FLORIDA. that:
The Board hereby Iinds that the donation of plant material (300 plants-Kalanchoe Landscape Type
"Veranda." 8 inches in height and 1002 plants-Euphorbia "Katies Crown." 6 inches in height) from American
Farms will serve a public purpose in that it will be utilized for the beautification and enhancement of public
rights-of way within the Bayshore MSTU boundaries.
This Resolution shall take effect immediately upon adoption.
