EXECUTIVE SUMMARY
County Attorney report on sidewalk requirement for the World Tennis Center Planned
Unit Development.
OBJECTIVE: To provide the 130ard information relating to the developer commitments
pertaining to sidewalks within the World Tennis Center Planned Unit Development.
CONSIDERATIOl'(S: On March 10,2009, Item 6C, the BCC directed the County Attorney to
advise them on the developer commitments for sidewalks within the World Tennis Center
Planned Unit Development alongside the canall'lcing AirpOI1 Road,
We have reviewed the World Tennis Center PlID, which was created by Ord. No. R2-1, as
amended by Ord. X2-75 and Ord. X7-93 PUD Ordinance, the Land Development Regulations and
Subdivision Regulations in effect at that time. We also made inquiry with respect to the Site
Development Plan.
It is our opinion that there is not now, nor has there cvcr been, any requirement for this
Development to place sidewalks alongside thc canal facing Airpol1 Road. It is the ful1her
opinion of this OfJice that there is no duty or obligation by the County to do so either.

In addition, there was a brief mention during this discussion of a 1994 invoice for a Developer
contribution for a trattic :dgnal. Any claim the County may have had with respcct to this matter
was waived long ago.
FISCAL IMPACT: Thcre is noliscal impact t" the County.
GROWTH MANAGEMENT IMPACT: There is no direct growth management impact.
RECOMMENDA T10N: That the Board ofCl'unty Commissioners takc no further action.
