EXECUTIVE SUMMARY
RECOMMENDATION TO APPOINT THE CHAIRMAN OF THE COLLIER COUNTY BOARD
OF COUNTY COMMISSIOENRS TO SERVE ON THE COLLIER COUNTY CANVASSING
BOARD FOR THE GOLDEN GATE FIRE AND RESCUE CONTROL DISTRICT SPECIAL
ELECTION TO BE HELD ON MAY l2,2009,ANDAN ALTERNATE
OBJECTIVE: To appoint the Chairman of the Collier County Commissioners to serve on the
Collier County Canvassing Board for the Golden Gate Fire and Rescue Control District Special
Election to be held on May 12, 2009, and an Alternate.
CONSIDERATIONS: Florida Statutes 102. I 4 I provides, in part, as follows:
(I) The county canvassing board shall be composed of the supervisor of elections; a county court
judge, who shall act as chair; and the chair of the board of county commissioners. In the event
any member of the county canvassing board is unable to serve, is a candidate who has
opposition in the election being canvassed, or is an active participant in the campaign or
candidacy of any candidate who has opposition in the election being canvassed, such member
shall be replaced as follows:

(c) If the chair of the board of county commissioners is unable to serve or is disqualified, the board
of county commissioners shall appoint as a substitute member one of its members who is not a
candidate with opposition in the election being canvassed and who is not an active participant
in the campaign or candidacy of any candidate with opposition in the election being canvassed.
Pursuant to Florida law, in the absence of any disqualifYing criteria, the Chairman of the Board of
County Commissioners shall serve on the county canvassing board. In the event that some subsequent
event may arise that would prevent the Chairman from serving, the Supervisor or Elections requests
that the Board also appoint an Alternate member from its body.
FISCAL IMPACT: None.
LEGAL CONSIDERATIONS: This item has been reviewed and approved by the County Attorney's
Office, is not quasi-judicial and requires no ex parte disclosure, requires only a majority vote for
approval, and is otherwise legally sufficient for Board action.-SRT
GROWTH MANAGEMENT:
None.
RECOMMENDATION: That the Board of County Commissioners the Chairman of the Collier
County Commissioners to serve on the Collier County Canvassing Board for the Golden Gate Fire and
Rescue Control District Special Election to be held on May 12,2009, and an Alternate.
