Once approved by the Board of County Commissioners, the Resolution will be transmitted to members of the Collicr County Legislative Delegation and the Florida Association of Counties. CONSIDERATION: At the BCC regular meeting on October 28, 2008, the Board voted during review and adoption of Collier County's 2009 State Legislative Priorities (Item 10C) to include the i~)l1owing priority: Support Florida Governmental Utility Authority (FGUA) being under State Public Service Commission oversight FISCAL IMPACT: There is no fiscal impact associated with this executive summary. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this executive summary. WHEREAS, the Board of County Commissioners on October 28, 2008 approved Collier County's 2009 State Legislative Priorities which include: Support Florida Governmental Utility Authority (FGUA) being under State Public Service Commission oversight; and WHEREAS, the Board of County Commissioners presented the County's approved priorities to members of the Collier County Legislative Delegation at a Pre-Legislative Session Workshop on November 14,2008, in the boardroom at the Collier County Government Center; and WHEREAS, the Board of County Commissioners presented the finalized list of Board of County Commissioners-endorsed priorities at the Collier County Legislative Delegation Meeting/Hearing held December 10, 2008, at which time there was a discussion about FGUA issues of concern; and WHEREAS, Representative Matt Hudson, chairman of the Collier County Legislative Dclegation, filed House Bill 69 I Relating to State Oversight of Utility Services Provided by Intergovernmental Authorities on February 3, 2009. The legislation deletes a provision exempting intergovernmental authorities from being subject to jurisdiction of the Public Service Commission (PSC); revises and provides definitions for water and wastewater systems; exempts certain water and wastewater systems from regulation by PSC; exempts intergovernmental Page 1 of2 Agenda item h!o, 16F5 fv1al-ch 10. 2009 Page 4 of 35 authorities from certain fees; and deletes exception to PSC's exelusive jurisdiction over utility systems subject to interIocaI utility agreements. The effective date is July 1, 2009; and WHEREAS, Senator Garrett Richter filed Senate Bill I 192 Relating to Utility Services, Oversight, and Intergovernmental Authorities. The legislation deletes a provision that exempts certain legal entities from the jurisdiction of the Public Service Commission (PSC); defines "intergovernmental authority"; exempts certain water and wastewater systems from regulation by the Commission; exempts an intergovernmental authority from certain fees; and deletes the exception of certain utility systems subject to interIocal utility agreements from the exclusive jurisdiction of the Commission, etc. The effective date is July], 2009. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the Board of County Commissioners does hereby support House Bill 691 and Senate Bill I 192, which address the County's priority ofPSC oversight of the FGUA. BE IT FURTHER RESOLVED that a copy of this resolution will be forwarded to the Florida Association of Counties and the Collier County Legislative Delegation. "Utility" means a water or wastewater utility and 57 includes every person, separate legal e~tity, lessee, trustee, 58 or receiver owning, operating, managing, or controlling a 59 system, or proposing construction of a system, who is providing, 60 or proposes to provide, water O~ wastewater service to the 61 public for compensation. 62 3. A separate legal entity that sS8ks to acquire any 63 utility shall notify the host government in writing by certified 64 mail about the con-::emplated acqui.sition not less than 30 days 65 before any proposed transfer of ownersh~PI Gse, or possession of 66 any utility assets by such separate legal entity. The potential 67 acquisition notice shall be provided to the legislative head of 68 the gover~ing body of the host government and to its chief 69 administrat~ve officer a~d shall provide the name and address of 70 a contac~ person for the separate legal entity and information I 71 identified i:1 s. 367.071(4) (a) ccncernlng .h~ \--LJC con~"emplated 72 acquisition. 73 4. a. The potential 68 acquisition ~otice shall be provided to the legislative head cf 69 the governing body of the host government and ~o its chief 70 administrative officer and shall provide ~he rame and address of 71 a contact person for the separate legal entity and information 72 identified in s. 367.071 (4) (a) concerning the contemplated 73 acquisition. 74 4.a. Within 30 days following receipt of the notice, the 75 host government may adopt a resolution to become a member of the 76 separate legal entity, adept a resolution to approve the utility 77 acquisition, or adopt a resolution to prohibit the JtiJity 78 acquisitio:1 by the separate legal entity if the host government 79 determines that the proposed acquisition is not in the public 80 interest.
