Agenda 03/10/2009 Item #16A 3 Agenda Item No. 16A3 March 10, 2009 Page 1 of 4 EXECUTIVE SUMMARY Recommendation that the Board of County Commissioners approve Award of Contract #08-5090 to Rhodes, Tucker & Garretson for Special Magistrate Services for Collier County Code Enforcement Department for approximately $80,000 per year, OBJECTIVE: To provide an equitable, expeditious, effective and inexpensive method of enforcing code and ordinances enacted by Collier County. CONSIDERATIONS: The current Agreement for Special Magistrate Services is expiring on March 29, 2009, and the Agreement contained no further renewals. Staff determined that it is in the best interests of the County to issue a Request for Proposal for the referenced services. The Scope of Services listed the tasks to include, but not be limited to: adopt rules and regulations for the conduct of hearings, subpoena alleged violators and witnesses to appear at hearings, subpoena evidence, take testimony under oath, hold hearings on violations of local codes and ordinances and contested citations, issue orders having the force of law to command whatever steps are necessary to bring a violation into compliance, assess administrative fines, costs, and to impose liens and order the payment of such fines, and authorize the County Attorney or his designee to foreclose on a lien or sue to recover a money judgment for unpaid fines and costs imposed by the Order of the Special Magistrate. The compensation is on an hourly basis at $175 per hour. Based on past practices, staff anticipates the total contract value to be approximately $80,000. The RFP was publicly advertised on September 8, 2008. Notices were sent to thirty- three (33) firms with nineteen (19) vendors requesting full packages. One (1) response was received by the due date of October 2, 2008. A Selection Committee was held on January 27, 2009, and after review and discussion, and by consensus of the members, the following firm was shortlisted; 1. Rhodes, Tucker & Garretson Staff has negotiated and reached agreement with the top ranked firm(s), Rhodes, Tucker & Garretson. FISCAL IMPACT: Funds for this contract are budgeted in MSTD General Fund (111) within Code Enforcement Operations. GROWTH MANAGEMENT IMPACT; While this has no direct impact on the Growth Management Plan, it is consistent with the goals of the County to streamline and expedite the procurement of services. LEGAL CONSIDERATIONS: This item is not quasi-judicial, and as such ex parte disclosure is not required. This item requires majority vote only.
