EXECUTIVE SUMMARY
Recommendation for the Board of County Commissioners to adopt a Resolution
to declare a public purpose and to allow Collier County Parks and Recreation to
create a Donation Fund for the solicitation, receipt and expenditure of donations
to Collier County Parks and Recreation to benefit youths, adults and senior
citizens.
Obiective: For the Board of County Commissioners to adopt the attached resolution
which declares a public purpose for Collier County Parks and Recreation to solicit.
receive, and expend donations for the benefit of, youth, adults and senior citizens, and
further authorizing Parks and Recreation to create a Donation Fund with the assistance
of the Clerk of Court.
Considerations: The Parks and Recreation Donation Fund would be used for the
following activities which serve a valid public purpose including but not limited to the
education and training for staff, volunteers and citizen groups, and planning and
implementing fund-raising events to benefit Parks and Recreation. The funds would
also be used for advertising fund-raising events, providing scholarships for recreational
and educational opportunities. Funds will be used in support of memorial programs,
scholarship programs and special needs programs.
The Parks and Recreation Department has developed various educational and
volunteer programs in all of the Parks facilities. The establishment of a Donation Fund
will provide Board authorization for donations and will enable Parks and Recreation to
effectively account for charitable donations from the community that have been
earmarked for specific purposes and would allow for the proper management of these
fund expenditures. It will further provide the means to carry donated funds from one
fiscal year to the next until the funds are expended for their intended purposes.
The Parks and Recreation Department will submit budget amendments for the
allocation of funds in compliance with the County's budgeting process.
Leaal Considerations: This item is not quasi-judicial, and as such ex parte disclosure
is not required. This item requires majority vote only. This item is legally sufficient for
Board action. - CMG
Fiscal ImDact: Approving this item will establish a separate Collier County Parks and
Recreation Donation Fund to properly account for and manage donations from the
community for designated programs and events that are designed to promote
community awareness for all recreational and therapeutic opportunities.

WHEREAS, the Board of County Commissioners of Collier County finds there is a
compelling public purpose for the Parks and Recreation Department ("PARKS") to solicit,
reccivc, and expend donations from private individuals, private corporations and/or community
groups and community events, for the purpose of providing recreational and therapeutic
opportunities for. youths, adults, and senior citizens; and
WHEREAS, the Board finds that the following activities serve a valid public purpose
including but not limited to: education and training staff, volunteers and citizen groups; planning
and implementing fund-raising events to benefit PARKS including advertising for fund-raising
events; providing scholarships for recreational opportunities; support of memorial programs and
purchasing supplies and recreational equipment; and
ViHEREAS, the Board finds it necessary for PARKS to work with the Office of the Clerk
of Court, Departmcnt of Finance, and Office of Management and Budget, to create a Parks and
Recreation Donation Fund for the collection and accounting of Parks and Recreation monetary
donations, and the Board directs the Office of the Clerk of Court. Department of Finance, and
Office of Management and Budget, to cooperate with PARKS in establishing and maintaining
said account in compliance with Florida Statutes; and
WHEREAS, the Board authorizcs PARKS to solicit and accept monetary and property
donations and to spend the donations in a manner consistent with the stated public purpose; and

WHEREAS, the Board further approves obtaining private and public donations for the
sole benefit ofP ARKS and its stated public purpose.
NOW THEREFORE, BE II' RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the Board hereby declares that
there is a compelling public purpose for the Parks and Recreation Department to solicit monetary
and property donations, receive such donations. and spend said donations and further to create a
Donation Fund for this purpose.
