EXECUTIVE SUMMARY
Recommendation to award Bid #09-5180 for construction of Bayshore Drive and
Thomasson Drive Stormwater Improvements, Project No. 51134.1, to Kyle Construction,
Inc. in the amount of $59,153.20 plus a ten percent contingency, and to approve the
necessary budget amendment.
OBJECTIVE: To receive Board approval for the award of a contract to proceed with the
Bayshore Drive and Thomasson Drive Stormwater Improvements Project for $59,153.20 per
plans and specifications to the lowest, qualified and responsive bidder, Kyle Construction, Inc.
CONSIDERATIONS: The bid was advertised on December 30,2008 in the Nap]es Daily News
and notices were sent to seven hundred sixty-two (762) vendors. On January 16, 2009, a non-
mandatory pre-bid meeting was held to explain the contract specitications and answer any
questions that the prospective bidders may have. On January 29, 2009, thirteen (13) bids were
received and reviewed by the Stormwater Management Section's Staff and the Project's Design
Professional in conjunction with the Purchasing Department. Responses were received from the
following firms:

Quality Enterprises USA, Inc.;
Stahlman-England Irrigation, Inc.
The thirteen (13) responsive base bids received ranged from $59,153.20 to $]91,140.00. Bid
costs are noted on the attachment. The Engineers project estimate was $90,000.00.
This stormwater project is located within rear lot drainage easements at the Northeastern
intersection of Bayshore Drive and Thomasson Drive. The proposed work generally consists of
clearing and grubbing, ditch realignment increasing the flow way's capacity, and construction of
an access maintenance pathway. Construction shall be in accordance with the plans and
specifications by Q. Grady Minor and Associates, P.A.

In this project's community involvement etforts, the Stormwater Management Section staff
notified the adjacent property owner(s) within the work zone. Adjacent owner and association
comments were considered in the design's tina] plans.

Staff has reviewed the bids received and recommends awarding the construction contract to Kyle
Construction, Inc. as the lowest, qualified and responsive bidder. Their base bid was the lowest
being $59,153.20.
FISCAL IMPACT: Funds in the amount of $55,344.78 are available in the Stonnwater
Management Section's Capital Fund 325, Project NO.5] 134.1. A budget amendment in the
amount of $9,723.74 is necessary to cover the bid amount of $59,]53.20 plus a ten pcrcent
contingency amount of $5,915.32 for unforescen relatcd expenses for a total amount of
$65,068.52. The source of additional funds bcing requested in the budget amendment
($9,723.74) is from one (l) recently completed stonnwater project.
LEGAL CONSIDERA nONS: This item has bcen rcviewed and approved by the County
Attorney's Office, is not quasi-judicia] and requircs no cx parte disclosurc, requires only a
majority vote for approval, and is othcrwise legally sufficient for Board action.--SRT
GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact associated
with this Executive Summary.
RECOMMENDA nON: That the Board of County Commissioners:
(1) Approve award of Bid No. 09-5180 to Kyle Construction, Inc. for the Bayshore Drive
and Thomasson Drive Stonnwater Improvements having Project No.5] 134.] for the total
Base Bid and of $59,] 53.20 plus a tcn percent (10%) contingency ($5,915.32) totaling
$65,068.52;
(2) Authorize the Chair to executc, subject to final rcview and approval by the County
Attorney's Office for legal sufficiency, the standard Board approved contract after
execution by the vendor.
(3) Approve the necessary budget amendment.
