OBJECTIVE: To receive Board of County Commissioners approval for the award of a contract to proceed with the Old US 41 Stormwater Improvements Project in the 3I11ount of$645,982.75 per plans and specifications to the lowest, qualified and responsive bidder, David Foote Environmental Construction, Inc. CONSIDERATIONS: The bid was advertised on November 22, 2008 in the Naples Daily News and notices were sent to seven hundred-sixteen (716) vendors. On December 10, 2008, a non-mandatory pre-bid meeting was held to explain the contract specifications and answer any questions that the prospective bidders may have. On December 22, 2008, thirteen (13) bids were received and reviewed by the Stormwater Management Section's staff and the Project's Design Professional in conjunction with the Purchasing Department. Bid alternates and costs are noted on the attachment. The Engineer's project cstimate was $800,000. Staff has reviewed the bids received and recommends awarding the construction contract to Dave Foote Environmental Construction, Inc. as the lowest, qualified and responsive bidder including the Bid Alternate. This stormwater project is located within Old US 41 Road Rights-of-Way south of the Collier County 3I1d Lee County line and continues south to the intersection of Old US 41 and New US 41. The proposed work generally consists of clearing and grubbing, relocation/widening of an existing roadside ditch, and side drain culvert replacements increasing the flow ways capacity, incidental pavement repairs, and water main defections. Construction shall be in accordance with the plans and specifications by Q. Grady Minor and Associates, P.A. Agenda Item No. 1666 January 27,2009 Page 2 of 7 In this project's community involvement efforts, the Stormwater Management Section staff notified the adjacent property owner(s) fronting on Old US 41. Adjacent owner comments and evaluation of the comments were considered in the design's final plans. With regards to awarding the project including Bid Alternate #1, after discussions with Road Maintenance regarding their past successful results with hydro-seeding operations vs. sodding, Road Maintenance recommends the placement of sod. With no import of additional soils or soil additives to the project, the low square yard installed cost at $1.52/sq. yd., and the time of the year of constructing to stonnwater improvements, the Storn1water Management Section is also recommending that Bid Alternate #1 for additional sodding be included in lieu of hydro-seeding thus adding an additional $63,080.00 to the bid. With the addition of Bid Alternate #1, Dave Foote Environmental, Inc. becomes $4,571.75 below the next bid submission of $650,554.50 (which also included Bid Alternate #1). FISCAL IMPACT: Funds in the amount of $710,581.03 (total construction 3ITIount of $645,982.75 plus a ten percent contingency 3ITIount of $64,598.28 for unforeseen related expenses) are available in the Stormwatcr Management Section Fund 325, Project No. 511331. LEGAL CONSIDERATIONS: This item has been reviewed and approved by the County Attorney's Office, is not quasi-judicial and requires no ex parte disclosure, requires only a majority vote for approval, and is otherwise legally sufficient for Board action.~SRT GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact associated with this Executive Summary. RECOMMENDATION: That the Board of County Commissioners: (I) Approve award of Bid No. 09-5040R to Dave Foote Environmental Construction, Inc., for the Old US 41 Stormwater Improvements Project No. 511331 for the total Base Bid and Alternate No.1 of $645,982.75 plus a ten percent (10%) contingency ($64,598.28) totaling $71 0,581.03; (2) Authorize the Chair to execute, subject to final review and approval by the County Attorney's Office for legal sutliciency, the standard Board approved contract after execution by the vendor. A total of 13 bids were received on the project. The Rid included a Base Bid and also a Bid Alternative. The Bid alternative provided for increased sodding of disturbed areas within the Right-of-Way in lieu of the specified hydroseeding in the Base Bid. It is a preference (especially by Road Maintenance) to utilize sod whenever possible to allow a quicker and more fuller establishment of grassed surfaces. The Base Bids ranged from $583,077.00 to $926,045.30 with Haskin Inc being the lowest, responsive bidder. The Bids with the Alternate rallged from $645,982.75 to $998,770.82 with Dave Foote Environmcntal Construction, Inc. being the lowest, responsive bidder. Based upon meetings with County staff, it is recommended that the Base Bid with Altemate be awarded to Dave Foote Environmental Construction Inc. for the amount of $645,982.75.
