Agenda 01/13/2009 Item #16E 5Agenda Item No. 16E5 January 13, 2009 Page 1 of 3 EXECUTIVE SUMMARY Recommendation to approve a Release and to accept payment in the amount of $155.55 resulting from the voluntary settlement between Willis Group Holdings, Inc. and the Office of the Attorney General. OBJECTIVE: To receive approval of a Release and to accept proceeds in the amount of $155.55 resulting from the voluntary settlement of the investigation of Willis Group Holdings, Inc. by the Office of the Attorney General on behalf of public entity clients in Florida regarding the matter of undisclosed insurance carrier compensation. CONSIDERATIONS: In November, 2004 the Attorney General of Florida issued subpoenas to approximately ten insurance brokerage firms in the State of Florida to examine the compensation practices of these firms and to determine if they were in violation of Florida's antitrust laws, Chapter 542, Florida Statutes. This action was similar to actions taken in New York which involved the Attorney General of New York and the brokerage firm of Marsh and McLennan, Inc. Willis Group Holdings, Inc. was a party to the investigation. Willis provides benefits brokerage services to the County. Willis cooperated with the investigation and ultimately agreed to a voluntary settlement with the Attorney General of Florida. As part of the settlement, Willis admitted no wrongdoing or liability. On November 25, 2008 a letter and Release form was received by the County from the Attorney General's office requesting that the Release form be signed in order to distribute the eligible proceeds of the settlement to the County. Staff requests approval of the Release and authorization for the Chairman to sign the Release to complete the settlement process. FISCAL IMPACT: The County is eligible to receive $155.55 from the settlement of this matter. These funds will be deposited to Fund 517, Group Health and Life, upon receipt. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this item. LEGAL CONSIDERATIONS: There are no legal considerations associated with this item. This item is not quasi judicial, and as such ex parte disclosure is not required. This item requires majority vote only.
