EXECUTIVE SUMMARY
Recommendation that the Board of County Commissioners of Collier County, Florida, as
Ex- Officio Board of the Collier County Water -Sewer District, approve a work order to
Mitchell & Stark Construction Company, Inc. in the amount of $290,650 for construction
of the water main replacement to accommodate the replacement of the Vanderbilt Drive
Bridge over the Cocohatchee River, Project 70045.
OBJECTIVE: To approve a work order regarding Collier County relocating its water facilities
necessitated by the Florida Department of Transportation (FDOT) replacing the Vanderbilt Drive
Bridge over the Cocohatchee River. The public purpose is to continue to provide potable water to
customers in the northwestern part of the water service area by the replacement of a 12 -inch
water main.
CONSIDERATIONS: On October 14, 2008, Agenda Item 16 C 3; the Board approved a
Resolution to approve a FDOT standard "Utility Work Agreement" (UWA). The UWA pertains
to the County construction of a replacement water main required by the FDOT project to replace
the Vanderbilt Drive Bridge.
On October 28, 2008, Agenda Item 10 B; the Board approved a Locally Funded Agreement
between the FDOT and Collier County for construction of the bridge which includes
bicycle /pedestrian improvements desired by Collier County. The County's share is funded by a
portion of the $3 Million mitigation collected from the Cocohatchee Bay Settlement Agreement.
On November 26, 2008, staff issued a request for proposals (RFQ) to construct the replacement
water main to the five contractors under Contract 08 -5011, "Annual Contract for Underground
Utility Contracting Services."
Proposals were received from the five contractors by the deadline stated in the RFQ of 10:00 AM
on December 12, 2008, as follows.
Mitchell & Stark Construction Company, Inc. $290,650.00
Quality Enterprises USA, Inc. $344,860.55
Haskins, Inc. $350,150.00
Douglas N. Higgins, Inc. $384,000.00
Kyle Construction, Inc. $397,799.00
Staff seeks the Board's approval of a work order to Mitchell & Stark Construction Company,
Inc., the lowest responsive proposer, to construct the replacement water main in the amount of
$290,650. Construction as well as design and construction engineering inspection (CEI) services
are to be funded by a portion of the $3 Million mitigation collected from the Cocohatchee Bay
Settlement Agreement. Approximately $1.24 million remains from this agreement.
FISCAL IMPACT: Funding totaling $440,685 is required for water and wastewater relocations.
The total includes $290,650 for this construction work order, $83,435 for engineering services,

$33,600 for CEI services, and $33,000 for utility work by the highway contractor. The $440,685
total will be paid by the proceeds from the Cocohatchee Bay Settlement Agreement.
LEGAL CONSIDERATIONS: This item has been reviewed and approved by the County
Attorney's Office, is not quasi - judicial and requires no ex parte disclosure, requires only a
majority vote for approval, and is otherwise legally sufficient for Board action. SRT
GROWTH MANAGEMENT IMPACT: This work order involves the relocation of existing
utilities so there is no growth management impact.
RECOMMENDATIONS: That the Board of County Commissioners, as the Ex- officio Board
of the Collier County Water Sewer District;
1. Approve a Work Order to Mitchell & Stark Construction Company, Inc. in the amount of
$290,650 for the replacement of a water main necessitated by FDOT replacing the
Vanderbilt Drive Bridge over the Cocohatchee River, and
2. Approve utilizing funds from the Cocohatchee Bay Settlement Agreement for the
relocation of County water and wastewater facilities.

This Work Order is for general contracting services, subject to the terms and conditions of the Contract
referenced above, for Work known as:
WATER MAIN REPLACEMENT, VANDERBILT DRIVE (CR 8111) AND COCOHATCHEE CANAL
The work is spekiBed in the proposal dated December 12, 2005 from Mitchell & Stack Construction
Company, Inc., which is attached hereto and made a part of this Work Order. In accordance with
Terms and Conditions of the Agreement referenced above, this Work Order is assigned to Mitchell &
Stark Construction Company, Inc,
Scope of Work: Provide all services called for In the plant and specifications to construct the water
main replacement on Vanderbilt Drive at the Cocohatchee Canal.
Schedule of Wort: Complete work within 134 calendar days from Notice to Proceed. Liquidated
damages will be seemed at $714.00 per day or each day this time is exceeded.
Compensation: In accordance with ttem 4 of the Agreement, On County will compensate the Firm in
accordance with the unit prices provided in the proposal.
TOTAL PRICE: $290.650.00
Any change made subsequent to final department approval will be considered an additional service
and charged according to an executed Change Order as enumerated in Exhibit D of the Agreement.
