Agenda 01/13/2009 Item #16B 2Agenda Item No. 16132 January 13, 2009 Page 1 of 5 EXECUTIVE SUMMARY Recommendation that the Board of County Commissioners (BCC) make a motion finding that the curb -and- gutter urban roadway cross - section constructed on Southwest Boulevard meets the commitment listed under Paragraph P, of Sub - section 7.5 "Transportation" of the Wentworth Estates Ordinance No. 2003 -51, adopted by the Board on September 23, 2003. OBJECTIVE: To obtain from the Board of County Commissioners a favorable motion that the provision in Paragraph 7.5 P. of the Wentworth Estates (Treviso Bay) PUD document pertaining to the type of roadway cross - section to be constructed for Southwestern Boulevard has been fulfilled. CONSIDERATION: On September 23, 2003, the Board adopted Ordinance No. 2003 -51, which became effective on October 3, 2003, when filed with Department of State. The PUD ordinance, in the attached Exhibit A, the PUD Document, set forth regulations pertaining to the Wentworth Estates PUD, which is more generally known as Treviso Bay. In Section VII of the PUD Document, entitled "Development Commitments," Sub - section 7.5 sets forth such commitments for "Transportation," which in Paragraph. P. thereof states: "The developer shall improve Southwest Boulevard to include two 12 -foot lanes, a curb - and- gutter urban roadway cross- section with enclosed drainage, and a sidewalk on each side of the road. These improvements will be designed to tie into the existing roadway network and improve area drainage. Improvements to Southwest Boulevard shall also include landscaping and lighting and shall improve the turning movement geometry at the intersection of Southwest Boulevard and US 41. These improvements shall be part of the Phase 1 construction plans and shall be reviewed and approved by Collier County. A bench and /or bus shelter shall also be included in the construction plans with the design and location coordinated by Collier County. (Emphasis added by italics) During this past November, as part of the County's annual PUD monitoring program all aspects of this PUD's commitment under Paragraph P. (along with many others) were reported as being "completed," except for compliance with the italicized text above pertaining to the cross - section of Southwest Boulevard being "a curb - and - gutter urban roadway cross - section with enclosed drainage. " In support of that statement, the completed cross - section was part of the construction plans approved under PPL- 2002 -AR -6434 on January 14, 2006. The actual improvements were approved and permitted under Right -of -Way Permit #22223 -E, issued April 4, 2006. These approvals reflected a design for the cross - section that since construction and preliminary inspection during the week of October 8, 2007, has demonstrated that the chronic seasonal flooding along the Southwest Boulevard ROW has been successfully alleviated and that the completed improvements otherwise comply with accepted standards for safe and efficient operation, pending final inspection. The cross - section, as installed, technically meets the requirement of a curb and gutter cross- section under FDOT Design Standards Index 301 with enclosed drainage. A valley curb and gutter section was constructed that collects water from the road and discharges to structures that also collect stormwater from the swales that control watershed for the neighborhood and conveys said Stormwater to the water management system for Treviso Bay, see attachment B. Additionally, these improvements have been maintained and operated for over one year without incident and complaints from the adjacent homeowners. FISCAL, IMPACT: There is no fiscal impact associated with this Executive Summary. It is not quasi judicial, and as such, it does not require ex parte disclosures. A majority vote of the Board is necessary for Board action.- -HFAC. GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact associated with this Executive Summary. RECOMMENDATION: That the Board of County Commissioners approve a motion finding that the provision in the Wentworth Estates' PUD document of Ord. No. 2003 -51, Paragraph 7.5. P., pertaining to the type of urban roadway cross - section facility constructed for Southwestern Boulevard, meets the requirements of the PUD, that section of roadway was permitted, constructed, and has now been in operation for more than one year. Changing the six -foot sidewalk on one or both sides of the roadway to an 8 -foot multi -use path. ii. Allowing a variable width median that may vary between 10 feet and 40 feet. iii. Modifying the typical 4:1 slope at the edge of the right -of -way to other grading solutions as conditions permit. 2. In areas adjacent to uplands, the developer reserves the right to make modifications to the Typical Spine Road Section to include the following: i. Allowing a variable width right -of -way that may vary between 100 feet and 150 feet. ii. Changing the 6 -foot sidewalk on one or both sides of the roadway to an eight foot multi -use path. iii. Allowing a variable width median that may vary between 10 feet and 90 feet. P. The developer shall improve Southwest Boulevard to include two 12 -foot lanes, a curb - and - gutter urban roadway cross - section with enclosed drainage, and a sidewalk on each side of the road. These improvements will be designed to tie into the existing roadway network and improve area drainage. hnprovements to Southwest Boulevard shall also include landscaping and lighting and shall improve the turning movement geometry at the intersection of Southwest Boulevard and US 41. These improvements shall be part of the Phase 1 construction plans and shall be reviewed and approved by Collier County. A bench and/or bus shelter shall also be included in the construction plans with the design and location coordinated by Collier County. Q. The developer shall provide up to $250,000 to supplement the funding for the installation of street lighting by the County, along US 41 from Broward Street to Collier Boulevard. This payment shall be made in accordance with the terms of the DCA. 7.6 WATER MANAGEMENT A. In accordance with the rules of the South Florida Water Management District, the Wentworth Estates PUD project shall be designed for a storm event of a 3 -day duration and 25 year storm return frequency. B. An excavation permit will be required for the proposed lakes in accordance with Division 3.5 of the Collier County Land Development Code. All lake dimensions will be approved at the time of excavation permit approval. C. The Wentworth Estates PUD conceptual surface water management system is shown on Exhibit "G ", Preliminary Drainage Plans & Details (JEI file No. VII -5
