A RESOLUTION BY THE BOARD OF COUNTY · COMMISSIONERS OF COLLIER COUNTY, FLORIDA, PURSUANT TO SECTION 2.7.3.4 OF THE COLLIER COUNTY LAND DEVELOPMENT CODE AFFECTING ORDINANCE NUMBER 97-4 KNOWN AS JACARANDA CENTER PUD, EXTENDING THE CURRENT PUD APPROV AL TO JANUARY 21, 2004; AND PROVIDING AN EFFECTIVE DATE. RESOLUTION NO.03- -2-9-8 WHEREAS, the Jacaranda Center PUD, Ordinance 97-4 adopted on January 21, 1997, is subject to the provisions of Section 2.7.3.4., of the Land Development Code (LDC), Time Limits for Approved PUD Zoning Districts together with their respective Master Plans; and WHEREAS, the PUD was adopted consistent with and under the provisions of the Collier County Growth Management Plan; and WHEREAS, there are mitigating circumstances that warrant the extension of the time in which to develop this project because the property consists of four separately owned platted lots each of which was owned and controlled by a separate individual; and WHEREAS, procuring authorization and designing a mutually agreeable plan took more time and effort than originally contemplated; and WHEREAS, those improvements were beyond the control of the project developer; and WHEREAS, the Board of County Commissioners has reviewed the PUD extension petition, identified as PUDEX-2003-AR-4383, filed by Terrance Kepple, of Kepple Engineering, inc., representing JTM Corporate Plaza, LTD., Antoino & Carmen Briceno, and Velma & Charles Bland, requesting an extension of the JACARANDA CENTER PUD per LDC Section 2.7.3.4.6. and have determined to extend the current PUD Zoning for two years, until January 21, 2004; and NOW, THEREFORE, BE IT RESOL VED, BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA that: 1. The above recitals are adopted herein by reference as if fully set forth herein. 2. This Resolution shall constitute evidence of compliance with the review requirements of Section 2.7.3.4 of the LDC. 3. Pursuant to said section of the LDC, the current PUD approval is hereby extended to January 21, 2004; by which date the owner will have complied with the procedures in LDC Section 2.7.3.4. This Resolution is effective immediately upon its adoption. BE IT FURTHER RESOLVED that this Resolution be recorded in the minutes of this Board and in the records of the Petition for which the extension is granted.
