A~ it A RESOLUTION BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, PURSUANT TO SECTION 2.7.3.4 OF THE COLLIER COUNTY LAND DEVELOPMENT CODE AFFECTING ORDINANCE NUMBER 98-61 KNOWN AS PINE RIDGE CORNERS PUD, EXTENDING THE CURRENT PUD APPROVAL TO JULY 1, 2005; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the PINE RIDGE CORNERS PUD, Ordinance number 98-61 adopted on July I, 1998, is subject to the provisions of Section 2.7.3.4., of the Land Development Code (LDC), Time Limits for Approved PUD Zoning Districts together with their respective Master Plans; and WHEREAS, the PUD was adopted consistent with and under the provisions of the Collier County Growth Management Plan; and WHEREAS, there are mitigating circumstances that warrant the extension of the time in which to develop this project in that this project could not begin construction until 1-75 related improvements were made along Pine Ridge Road; and WHEREAS, those improvements were beyond the control of the project owner; and WHEREAS, the Board of County Commissioners has reviewed the PUD extension petition, identified as PUDEX-2003-AR-432S, filed by Gary Butler, of Butler Engineering, Inc., representing Teryl H. Brzeski, requesting an extension of the Pine Ridge Corners pun per LDC Section 2.7.3.4.6. and have determined to extend the current PUD Zoning for two years and has determined to extend the current PUD Zoning for two (2) years, until July I, 2005; and NOW, THEREFORE BE IT RESOLVED, BY THE BOARD OF COUNTY COMISSIONERS OF COLLIER COUNTY, FLORIDA that: 1. The above recitals are adopted herein by reference as if fully set forth herein; and 2. No changes to the PUD document or the Master Plan are approved as part of this action; and 3. This Resolution shall constitute evidence of compliance with the review requirements of Section 2.7.3.4 of the LOC; and 4. Pursuant to said section of the LOC, the current PUD approval is hereby extended to July 1, 2005; by which date the owner will have complied with the procedures in LDC Section 2.7.3.4. This Resolution is effective immediately upon its adoption. BE IT FURTHER RESOL VEO that this Resolution be recorded in the minutes of this Board and in the records of the Petition for which the extension is granted.
