Resolution 2004-032 i 9D ,I RESOLUTION NO. 2004-32 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, TO DECLARE A VACANCY ON THE BAYSHORE/ AVALON BEAUTIFICATION MSTU ADVISORY COMMITTEE WHEREAS, on December 16, 1997, the Board of County Commissioners adopted Collier County Ordinance No. 97-82, establishing the Bayshore/Avalon Beautification Municipal Service Taxing Unit and creating the Bayshore/Avalon Beautification MSTU AdviSOry Committee; and WHEREAS, Collier County Ordinance No. 97-82 provides that the Bayshore/Avalon Beautification MSTU Advisory Committee shall consist of five (5) members; and WHEREAS, Section Eight of Collier County Ordinance No. 2001-55 provides, in pertinent part that: "Any board member who is absent for more than one-half of the Board's meetings in a given fiscal year shall be deemed to have tendered his or her resignation from such Board. The Commission shall, as soon as practicable after such resignation, declare the position to be vacant and shall promptly fill same pursuant to the provisions of Section Six herein;" and WHEREAS, after discussion by the Bayshore/Avalon Beautification MSTU Advisory Committee at their regular meeting of January 14, 2004, the Committee has advised the Board of County Commissioners that Edward McCarthy has failed to comply with the requirements set forth in Ordinance No. 2001-55, and has requested that the Board of County Commissioners declare that the seat held by Edward McCarthy be vacant on their Committee. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLUER COUNTY, FLORIDA, that after consideration of the facts presented, the Board of county Commissioners hereby declares the seat of Edward McCarthy to be vacant on the Bayshore/Avalon Beautification MSTU Advisory Committee. This Resolution adopted after motion, second and majority vote.
