Resolution 2004-029 RESOLUTION NO. 2004-29 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF COLUER COUNTY, FLORIDA, TO DECLARE VACANCIES ON THE PUBUC VEHICLE ADVISORY COMMITTEE f: 9 A WHEREAS, the Public Vehicle Advisory Committee was established by Collier County Ordinance No. 95-66, as amended; and WHEREAS, Collier County Ordinance No. 95-66, as amended, provides that the Public Vehicle Advisory Committee shall consist of five (5) members and one (1) alternate with not less than two (2) nor more than three (3) of the members being affiliated as holders of certificates to operate a motor vehicle for hire company within Collier County; and WHEREAS, Section Eight of Collier County Ordinance No. 2001-55 provides, in pertinent part that: "Any board member who is absent for more than one-half of the Board's meetings in a given fiscal year shall be deemed to have tendered his or her resignation from such Board. The Commission shall, as soon as practicable after such resignation, declare the position to be vacant and shall promptly fill same pursuant to the provisions of Section Six herein;" and WHEREAS, Patricia M. Baisley, representing the Affiliated category, is no longer a certificate holder and therefore no longer qualifies for the Affiliated category; and WHEREAS, the Chairman of the Public Vehicle Advisory Committee advised the Board of County Commissioners that Nickolas Whitney (representing the Affiliated category) and Eric Hyde (representing the Non-Affiliated category) have failed to attend several meetings without a satisfactory excuse in violation of the requirements set forth in Ordinance No. 2001-55, and has requested that the Board of County Commissioners declare the above seats be vacant on their Committee. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLUER COUNTY, FLORIDA, that after consideration of the facts presented, the Board of County Commissioners hereby declares the seats of Patricia M. Baisley, Nickolas Whitney and Eric Hyde to be vacant on the Public Vehicle Advisory Committee. This Resolution adopted after motion, second and majority vote. DATED: January 27, 2004 ATTEST' . .
