Agenda 04/23/2019 Item #16D 5 (Revised 2018 FTA Section 5324)04/23/2019 EXECUTIVE SUMMARY Recommendation to approve the submittal of a revised 2018 Federal Transit Administration (FTA) Section 5324 Emergency Relief Grant application in the amount of $ 196,978 to repair damages to Collier Area Transit (CAT) vehicles and facilities as a result of Hurricane Irma, approve the acceptance of the award through the Transit Award Management System (TrAMS), and authorize the necessary Budget Amendment. OBJECTIVE: To obtain grant funding to cover costs of damages to CAT vehicles and facilities caused by Hurricane Irma. CONSIDERATIONS: On September 11, 2018, the Board of County Commissioners (Board) approved the submittal of a 2018 FTA Section 5324 Emergency Relief grant application in the amount of $226,326.76 to repair damages to CAT vehicles and facilities as a result of Hurricane Irma. During the FTA review process, revised application guidance was issued in December 2018 and the application was revised to meet those requirements. The application now requires a ten percent (10%) match for capital expenditures that were paid after June 4, 2018. The grant will pay one-hundred percent (100%) of capital expenditures paid before June 4, 2018 as well as all hurricane related operating costs. The new guidance also required CAT staff to submit cost estimates and all paid invoices to FTA in order to determine the funding amount to be awarded to Collier County. Based on the invoices and estimates provided January 2, 2019, the FTA approved an award amount of $196,978. A revised grant application has been entered into TrAMS to utilize these funds. The application was prepared and attached for Board approval. After review and approval by FTA, the grant award is electronically executed in TrAMS by the Public Services Department Head who serves as the Board- appointed designee. Public Transit & Neighborhood Enhancement (PTNE) and the Office of Management and Budget grants compliance staff will also use this electronic system to manage the project and submit all required reports. Be aware that your Sam.gov is expiring in November 2018. 2. Please send me the Talking Points. (Example in Application Template Language document) 3. Missing FEMA statement, review Application Template Language. Specifically, state if any FEMA funds have been received for transit-related projects. Have you made any FEMA claims on these items? 4. Need STIP comment, review page 38 of manual and select correct STIP statement from Application Template Language document. 5. Missing Insurance statement on P1, correct it on P2 as well. See attached. If Insurance claims have not been made please explain why. Insurance. Indicate if ALI items are insured and were previously insured. Specify if: a. (1) insurance claim to collect funds is being or has been filed, b. (2) insurance proceeds from damages have been received, and c. (3) insurance funds have been applied to the project. 6. In P2 (project 2), make sure the amount in the project description matches the amount requesting for project. You added .76 cents in one. 7. In both projects (P1 & P2) please add how it will benefit the residents and visitors (transit.. etc.). 8. In the P2 Extended Budget description, provide the breakdown of the operating assistance = transit labor, equipment, and vendor related costs. Then breakdown must be written out. 9. There are 23 attachments, the expense to backup documentation must be easy to identify. Please add in the ALI description, when breaking down the expenses which attachment is referring to which expense, for example transit labeled= $###,###- see attachment labeled “Title of document”. 10. In P2- clearly explain and show how the 57K was reached. For the salary portion, only include in the attachment what is being requested, no additional information- show a summary of cost at the end that will match the ALI. 11. In P1, Bus shelters- please add bid award and delivery date. Leave the other milestones dates in. 12. In P1- Bus shelters, please add if this was an emergency repair in the ALI name. Is this a permanent repair or emergency repair? See manual for explanation. Review page 38 of manual on STIP requirements. 13. In P1- REHAB/RENOVATE - ADMIN/MAINT FACILITY, label your ALI to describe if this is a permanent repair or emergency repair. Look at STIP requirements and local share. Please add bid award and delivery date milestones. Review NEPA requirements for this item. 14. Fix grant to not go over your allocation. Collier County has $226,000 allocated, the grant is requesting $226,326, please reduce the grant by $326. 15. Review Application Template Language document, Executive Summary of grant should begin with: First sentence template, “This is an FFY 2018 Section 5324 application in the amount of $XXXX. The application is for (provide description of projects), for Hurricane XXXX.” 16. The end date of your grant will be established by looking at your latest milestone, if your latest milestone ends for example July 2020, then you need to add two years and run it to the next March 30th. In this example, the two years would be July 2022 and then run it to the next march 30 making it March 30, 2023. 17. Code all ALI’s as Operating, but keep their name as they are, (for ER grants, even Capital items are to be labeled as Operating Assistance). 18. On 1032-2018-5-P2- correct NEPA, you need to select This Project and each ALI activity have a separate, individual NEPA finding 19. Review your start and end dates on all your milestones: The Secretary has 16.D.5.a Packet Pg. 1826 Attachment: UNEX APP 2019 04-23 DR FTA 5324 (8515 : FY18 FTA 5324 Revised App) determined that the Federal share for ER funds used for emergency operations, emergency protective measures, and emergency repair costs (these terms are defined in the Emergency Relief final rule) incurred for up to 270 days from the date of the major disaster declaration will be 100 percent, thus waiving all of the non-Federal share. After 270 days past the major disaster declaration the Federal share drops to 90 percent. NOTE: We will need local share of 10% for items/expenses after these 270 days. See attached for your dates. If FTA and the Recipient determine that FEMA data is unavailable or insufficiently detailed, then other Federal, State, or local data may be used as the “best available information,” and e. If an FTA funded project activity is located in a floodplain, then the “best available information” requires a minimum baseline standard for elevation of no less than that found in FEMA’s ABFEs, where available, or if that is not available, then a minimum baseline standard for elevation of no less than FIRM, 16.D.5.a Packet Pg. 1833 Attachment: UNEX APP 2019 04-23 DR FTA 5324 (8515 : FY18 FTA 5324 Revised App) 12.
