Agenda 04/23/2019 Item #16A11 (Commitment Release - Green Heron PUD)04/23/2019 EXECUTIVE SUMMARY Recommendation to release a Planned Unit Development (PUD) commitment for an emergency accessway within the Green Heron PUD. OBJECTIVE: To release a PUD commitment for an emergency accessway within the Green Heron PUD. CONSIDERATIONS: In May 1982, the Board of County Commissioners (BCC) first approved the Green Heron PUD and the Green Heron Development of Regional Impact (DRI). Both were amended in 1984, and the PUD was amended again in 1995. The DRI was deemed essentially built out in 2016 through Resolution 16-208. Section 8.4 of PUD Ordinance 95-30 contains the following requirement: The developer shall provide a two-lane emergency accessway from Radio Road to the project perimeter road near the southeast corner of the project. The PUD Master Plan within the current Ordinance shows only one access point into the 221 -acre PUD. During the PUD approval, an accessway was requested so that in an emergency there was a second ingress/egress within the PUD for both residents and emergency vehicles. However, as the development has progressed, there are now three separate access points into the development, in lieu of the originally envisioned one with an additional emergency access. The residential portion of the PUD has been built out since 2007, and the final parcel is now under construction as an assisted living facility. The three Homeowner’s Association’s (HOA) within the Green Heron PUD along with the last developer within the PUD have each filed a request pursuant to Section 10.02.13.F.5 of the Land Development Code for release of a PUD commitment. This LDC Section states: A release of a PUD commitment determined to no longer be necessary shall be brought as an agenda item to the Board of County Commissioners for their approval. Staff, the Developer, and the HOA’s agree that the commitment is no longer necessary and have therefore asked staff to place this request on a regularly scheduled Board agenda for consideration. FISCAL IMPACT: There are no negative fiscal impacts should the Board approve this request. GROWTH MANAGEMENT IMPACT: No growth management impact associated with this action. LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, is approved as to form and legality, and requires majority vote for approval. -JAK RECOMMENDATION: The BCC determine that based upon Section 10.02.13.F.5. of the Land Development Code, Section 8.4 of PUD Ordinance 95-30 is no longer necessary and release the property owners from the commitment.
