EXECUTIVE SUMMARY
Recommendation to approve and authorize the Chairman to sign a Collier County Landscape
Maintenance Agreement (“Agreement”) between Collier County and Mattamy Tampa/Sarasota,
LLC, for landscape and irrigation improvements within the Bayshore Drive and Pine Street Public
Rights-of-Way.
OBJECTIVE: That the Board of County Commissioners (Board) approves and authorizes the Chairman
to sign the attached Collier County Landscape Maintenance Agreement permitting landscaping and
irrigation improvements within the County rights-of-way and ensuring that Mattamy Tampa/Sarasota,
LLC, will maintain improvements accordingly.
CONSIDERATIONS: Collier County was approached by Mattamy Tampa/Sarasota, LLC, to install sod
and irrigation adjacent to the Arboretum residential development within the Bayshore Drive and Pine
Street public rights-of-way. Pursuant to the attached Landscape Maintenance Agreement, the owner
agrees to maintain the sod and irrigation improvements within Bayshore Drive and Pine Street , as
described in the landscape plans attached to the Agreement. Rights to terminate the Agreement are spelled
out in the attached Agreement.
FISCAL IMPACT: There is no cost to Collier County associated with this proposal. Mattamy
Tampa/Sarasota LLC., is responsible for all recording fees.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
Executive Summary.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and requires a
majority vote for Board approval-SAS.
RECOMMENDATION: To sign a Collier County Landscape Maintenance Agreement between Collier
County and Mattamy Tampa/Sarasota, LLC, for landscape and irrigation improvements within the
Bayshore Drive and Pine Street Public rights-of-way.
