Thank you Attachment 1603 SECOND AMENDMENT TO AGREEMENT BETWEEN COLLIER COUNTY,FLORIDA AND HABITAT FOR HUMANITY OF COLLIER COUNTY,INC. 4h This AGREEMENT is made and entered into as of this lo( day of March 2019,by and between Collier County, a political subdivision of the State of Florida (the "COUNTY" or "Grantee") and Habitat for Humanity of Collier County, Inc. a private not-for-profit corporation existing under the laws of the State of Florida. WITNESSETH WHEREAS, on June 27, 2017, Agenda Item 16.D.11, the County entered into an Agreement with Habitat for Humanity to administer the State Housing Initiatives Partnership (SHIP) Owner Occupied Rehabilitation Program("Agreement"). WHEREAS, on August 14, 2018, Agenda Item 16F1, the County approved the First Amendment to Agreement. WHEREAS, the Parties desire to amend the Agreement to allow Habitat for Humanity to operate as a Sponsor and/or General Contractor. WHEREAS,the Parties desire to amend the Agreement to decrease total award amount by $120,000.00. The new Fiscal Year 2015-2016 funding for this project is not to exceed $143,774.00. The new Fiscal Year 2016-2017 funding for this project is not to exceed $496,226.00. WHEREAS, the parties wish to amend the Agreement to include the additional language below. NOW, THEREFORE, in consideration of the mutual promises and covenants contained herein, the parties hereto agree to amend the Agreement as set forth as follows: 1. All references in the Agreement to "Sponsor" shall be amended to "Sponsor and/or General Contractor"throughout the Agreement. 2. Habitat for Humanity may operate as both the SPONSOR AND GENERAL CONTRACTOR on designated rehabilitation projects. If the SPONSOR is also the GENERAL CONTRACTOR, the County will not pay project delivery to the Sponsor. 3. The budget amount for each fiscal year may be spent in other fiscal years as set forth in Exhibit C. Exhibit B is amended as follows: 1603 EXHIBIT B PROGRAM NARRATIVE OWNER OCCUPIED REHABILITATION PROGRAM * A. DESCRIPTION OF WORK TO BE PERFORMED * * * 2. If acting in the capacity of a SPONSOR on the property,the SPONSOR will issue an Invitation to Bid(ITB) or quote utilizing the County's Purchasing Policy to potential building contractors for each property. Each ITB or quote will be advertised in accordance with the County Purchasing Policy. The SPONSOR shall be responsible for issuing the ITB or quote, responding to questions, conducting the walk-through with the potential contractors (if necessary) and making the recommendations for awards. If the Sponsor choses to submit a bid as a General Contractor on a rehabilitation project the County will receive sealed bids and will make a fmal recommendation for award based on the Independent Costs Estimate provided by a third-party Inspector. The Sponsor may only be selected as the GENERAL CONTRACTOR if they are the lowest,responsive bidder. The Sponsor is not permitted to bid or act as the GENERAL CONTRACTOR on any properties where they have a mortgage interest. All bids will be validated by the County's independent third- party inspector and by the County. Project delivery is paid for each property rehabilitated and is 10% of the total cost of rehabilitation. If the Sponsor, is also the General Contractor, the County will not pay a project delivery fee to the Sponsor on that home. 3. The SPONSOR and/or GENERAL CONTRACTOR shall have 120 days from NTP approval by CHS until final inspection approval,by the third-party inspector to complete the rehabilitation, In the event that the SPONSOR and/or GENERAL CONTRACTOR fails to complete the necessary rehabilitation within the time frame the project delivery fee associated with the unit shall be forfeited unless CHS allows time extension. In the event of an unforeseen delay a written explanation and approval must be obtained from by the SPONSOR and/or GENERAL CONTRACTOR, for CHS to allow any time extension to the rehabilitation. Associated work to perform technical and administrative work involving the construction and renovation of residential properties.
