BEFORE ME, the undersigned authority, personally on this I day of March, 2019,
appeared ROGER B. RICE, who to me is well known, and having been sworn and under oath,
deposes and states:
1. My name is ROGER B. RICE. I am over the age of twenty-one (21) years,
and otherwise sui furls, and have personal knowledge of the facts contained herein.
2. I am a licensed attorney, Florida Bar Number 0752444, authorized to practice in
the State of Florida. My business address is: 9010 Strada Stell Court, Suite 207, Naples, Collier
County, Florida 34109. My business telephone number is: (239) 593-1002. My business mailing
address is: 9010 Strada Stell Court, Suite 207, Naples, Florida 34109.
3. This Affidavit is given to COLLIER COUNTY, a political subdivision of the
State of Florida("Purchaser"),to induce Purchaser to purchase that certain real property described
as:
A PORTION OF LOT 10, CITY GATE COMMERCE PARK PHASE THREE, AS
RECORDED PLAT BOOK 63, PAGE 84, OF THE PUBLIC RECORDS OF COLLIER
COUNTY, FLORIDA, LYING IN SECTION 35, TOWNSHIP 49 SOUTH, RANGE 26
EAST, COLLIER COUNTY, FLORIDA, BEING MORE PARTICULARLY DESCRIBED
AS FOLLOWS: ALL OF SAID LOT 10,LESS THE WEST 52.77 FEET.
4. The Affiant has examined company records of CG II, LLC through March 1st,
2019, including but not limited to, operating agreements, articles of organization, resolutions and
company records of members, if any.
5. CG II, LLC, is a Florida limited liability company.
6. CG II,LLC is organized,existing and in good standing under the laws of the State
of Florida.
7. The Operating Agreement of the CG II,LLC provides that officers of the company
may be designated.
8. Since inception,Joseph R.Weber has been appointed as Vice President of CG II,
LLC and has full power and authority, in his capacity as Vice President, to execute interests in
real property on behalf of CG II, LLC, including the conveyance of the property described in
Exhibit"A" attached hereto, and all necessary consents have been obtained.
9. CG II, LLC is not currently a debtor in a bankruptcy proceeding and this
conveyance is in the ordinary course of business.
10. Affiant further states that he is familiar with the nature of an oath and with the
penalties as provided by the laws of the State of Florida for falsely swearing to statements made in
an instrument of this nature. Affiant further certifies that they have fully read this affidavit and
understand its contents.
