EXECUTIVE SUMMARY
Recommendation to approve final acceptance of the sewer facilities and accept unconditional
conveyance of a portion of the sewer utility facilities for Bayshore Food Truck Park,
PL20180003357.
OBJECTIVE: To have the Board of County Commissioners, as Ex-Officio Governing Board of the
Collier County Water-Sewer District, approve final acceptance and unconditional conveyance of a portion
of the sewer facilities, in accordance with the Collier County Utility Standards and Procedures, Ordinance
No. 2004-31.
CONSIDERATIONS:
1) The Developer of Bayshore Food Truck Park has constructed the sewer facilities within dedicated
easements to serve this private development (see attached location map).
2) Collier County Public Utilities Department granted the Developer of Bayshore Food Truck Park, a
utility deviation that permitted the project to deviate from the standard utilities acceptance process,
allowing the project to skip the one-year warranty period (and associated performance security) and
go straight into final utility acceptance. Public Utilities staff justified the deviation because the value
of these sewer utility facilities (assets) is $257.32, which is very low compared with most utilities
conveyed to the County (See attached asset sheet).
3) Staff recorded the sewer conveyance documents associated with the facilities being conveyed to the
County in the public records of Collier County, which were reviewed and approved by the County
Attorney’s office as to form and legality. The County acquired its record interest by Utility Facilities
Warranty Deed, and Bill of Sale recorded in Official Records Book 5593, at Page 2515, of the Public
Records of Collier County, Florida.
3) A final inspection to discover defects in materials and workmanship has been conducted by staff on
November 19, 2018, in coordination with Public Utilities, and these facilities have been found to be
satisfactory and acceptable.
4) Staff recommends final acceptance of the subject sewer utility facilities.
5) This final acceptance is in accordance with Collier County, Ordinance No. 2004-31, as amended.
6) Staff is unaware of any issues that would serve to negate the recommendation to release the
applicable security.
FISCAL IMPACT: Approval of this Executive Summary will have no specific financial impact.
However, approval of this Executive Summary will result in the Collier County Water -Sewer District
receiving unconditional title to the utility facilities, which has a total gross value of $257.32 (no
depreciation applied).
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
action.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and requires a
majority vote for Board approval -SAS
RECOMMENDATION: To approve final acceptance of the sewer facilities and accept unconditional
conveyance of a portion of the sewer utility facilities for Bayshore Food Truck Park, PL20180003357.
