Resolution 2005-350 ~ RESOLUTION NO. 05-350 A RESOLUTION OF THE BOARD OF ZONING APPEALS AMENDING RESOLUTION NUMBER 05-34 TO CORRECT A SCRIVENER'S ERROR WHEREIN THE ACTION OF THE BOARD OF ZONING APPEALS WAS NOT CORRECTLY REFLECTED IN THE ADOPTED RESOLUTION IN PETITION NUMBER SV-2004-AR-650l FOR A SIGN VARIANCE. WHEREAS, the Collier County Board of Zoning Appeals adopted Resolution Number 05-34, on January 11, 2005, and; WHEREAS, following said action adopting Resolution Number 05-34, Zoning and Land Development Review staff determined that the Resolution did not contain the correct action as stated at the Board of Zoning Appeals and therefore constitutes a scrivener's error. I NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ZONING APPEALS OF COLLIER COUNTY, FLORIDA, that: SECTION ONE: SCRIVENER'S ERROR AMENDMENT The resolution is hereby amended to correct a scrivener's error by changing the Board of Zoning Appeals' action to read as follows: \l/HEREi\S, LDC Section 5.06.06.C only allO\vs one ground or pole sign and Fidelity has hvo, the second of which is non conforming such that Fidelity is theref-ore requesting a variance to allow' it to have t\VO 6 foot by 2 foot ground signs, rather than one sign aIlo'.ved by the LDC code, WHEREAS. LDC Section 5.06.06.C. (1) allows two llround sillns onlv so lonll as there is a minimum 1.000 seoaration between the signs such that Fidelitv is therefore reauesting a variance to allow it to have two existinll 6-foot bv 2-foot ground sillns with an aooroximate seoaration of 325 feet between the signs all as shown on the attached plot plan, Exhibit "A", in a C-4 zoning district for the property hereinafter described; and WHEREAS. the Collier Countv Planninll Commission has found as reauired bv LDC Section 9.04.02A.. that to the maximum extent oossible grantinll the variance will not diminish or otherwise have a detrimental effect on the oublic interest. safetv. or welfare: and the BZA has found as a matter of fact that satisfactory provision and arrangement has been made concerning all applicable matters required by LDC Sections 5.06.06.C & 9.04.03; and NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ZONING APPEALS OF COLLIER COUNTY, FLORIDA, that: The Petition SV-2004-AR-650l filed by Kyle Bach of Site Enhancement Services, representing Fidelity Building, L TD, with respect to a silln variance from LDC Section 5.06.06 C. en which allows two llround sillns onlv so lonll as there is a minimum 1.000 seoaration Words struolc through are deleted; words double underlined are added.
