Agenda 02/26/2019 Item #16A1002/26/2019 EXECUTIVE SUMMARY Recommendation to approve waiving the boat dock extension application fees for PL20180003485 and applicable building permit fees to remove and replace an existing boat dock located at 3266 Lakeview Drive, Naples, FL 34112. OBJECTIVE: To waive application fees for the boat dock extension application and associated building permit fees for the replacement of a boat dock that was originally built based on staff approval of a boat dock extension that did not meet required setbacks per the Land Development Code. CONSIDERATIONS: A boat dock petition for 3266 Lakeview Drive, Naples, FL, 34112 was approved by the Collier County Planning Commission under Resolution 99-40 on October 27, 1999, to allow for a 35-foot boat dock facility and a 15-foot boat dock extension. The dock was constructed under permit No. 2001062170, but the permit never received a certificate of completion because it did not meet the Land Development Code required setbacks to the adjacent property, and the permit subsequently expired. The original boat dock and extension were built parallel to its property instead of a perpendicular orientation that is consistent with other boat docks built on nearby properties. This parallel orientation of the boat dock would block access to any proposed boat dock built for the adjacent property. The property owner at 3266 Lakeview Drive has applied for a new boat dock extension (PL20180003485) to build a revised dock with a perpendicular orientation that will meet the requirements of the Land Development Code. Since the original boat dock extension was reviewed and approved even though the setbacks did not meet the Land Development Code, staff is supportive of waiving the application fees for PL20180003485 and associated building permit fees. FISCAL IMPACT: The fiscal impact associated with this Executive Summary shall not exceed $2,500. GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact associated with this action. LEGAL CONSIDERATIONS: This item is approved as to legality, and it requires a majority vote for Board approval.
