EXECUTIVE SUMMARY
Recommendation to approve final acceptance of the potable water and sewer facilities for My
Other Place III, PL20180002685, and accept unconditional conveyance of a portion of the potable
water utility facilities.
OBJECTIVE: To have the Board of County Commissioners, as Ex-Officio Governing Board of the
Collier County Water-Sewer District, approve final acceptance of the potable water and sewer facilities,
and accept unconditional conveyance of a portion of the potable water facilities, in accordance with the
Collier County Utility Standards and Procedures, Ordinance No. 2004-31.
CONSIDERATIONS:
1) The Developer of My Other Place III, has constructed the potable water and sewer facilities within
dedicated easements to serve this development. (See attached location map). A portion of the
potable water facilities will be conveyed to the County, as described in Official Records (O.R.) Book
5554, Page (PG) 3386. The remaining potable water facilities and all sewer facilities will be private.
2) Collier County Public Utilities Department granted the Developer of My Other Place III, a utility
deviation that permitted the project to deviate from the standard utilities acceptance process,
allowing the project to skip the one-year warranty period (and associated performance security) and
go straight into final utility acceptance. Public Utilities staff justified the deviation because only a
small section of potable water facilities is being dedicated to the County, while the remainder of th e
potable water and the sewer utility facilities for the entire project are private. They also noted that
the value of these water utility facilities (assets) is $1,918, which is very low compared with most
utilities conveyed to the County (See attached asset sheet).
3) Staff recorded the potable water conveyance documents associated with the facilities being conveyed
to the County in the public records of Collier County, which were reviewed and approved by the
County Attorney’s office as to form and legality. The County acquired its record interest by Utility
Facilities Warranty Deed and Bill of Sale recorded in O.R. Book 5554, at PG 3386, of the Public
Records of Collier County, Florida.
5) A final inspection to discover defects in materials and workmanship has been conducted by the
Development Review staff on September 7, 2018, in coordination with Public Utilities and these
facilities have been found to be satisfactory and acceptable.
6) The on-site potable water and sewer utilities, less the potable water utilities described in O.R. Book
5554, PG 3386, are owned and maintained by the developer.
7) Staff recommends final acceptance of the subject water utility facilities.
8) This final acceptance is in accordance with Collier County Ordinance No. 2004-31, as amended.
9) Staff is unaware of any issues that would serve to negate the recommendation to release the
applicable security.
FISCAL IMPACT: Approval of this Executive Summary will have no specific financial impact.
However, approval of this Executive Summary will result in the Collier County Water-Sewer District
receiving unconditional title to the utility facilities, which has a total gross value of $1,918 (no
depreciation applied) and an asset will be recorded in the financial records of the county.

GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
action.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and requires a
majority vote for Board approval - SAS

utility facilities.
