EXECUTIVE SUMMARY
Recommendation to approve an Easement Use Agreement (Agreement) for Lot 34, Aviano at
Naples, according to the plat thereof as recorded at Plat Book 43, Pages 67 through 71 of the public
records of Collier County.

OBJECTIVE: To approve an Easement Use Agreement between the County, the current property owner
of Lot 34, Aviano at Naples and the Aviano at Naples Homeowner’s Association, Inc.
CONSIDERATIONS: The property is located at 12788 Aviano Drive. The pool enclosure located along
the north property line of the house on the subject property encroaches 4.8 inches into a 20 -foot Lake
Maintenance Easement located along the northern property line. The current owner installed the
improvements. The subject easement is dedicated to Collier County with no responsibility for
maintenance and to Aviano at Naples Homeowner’s Association, Inc., with responsibility for
maintenance, according to the Aviano at Naples plat. The Homeowner’s Association has no objection to
the encroachment and is a party to the Agreement. There are no drainage or other County facilities within
the easement. Development Review has reviewed the Agreement and Exhibits and recommends approval
of the Easement Use Agreement.
FISCAL IMPACT: There is no fiscal impact. The property owners will be responsible for the
recording fees.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with
this action.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and requires a
majority vote for Board approval. SAS
RECOMMENDATIONS:
1. To approve the Easement Use Agreement between the County, current property owner of Lot 34 of
Aviano at Naples, and the Aviano at Naples Homeowner’s Association, and authorize the
Chairman to execute the Agreement.
2. Direct the Clerk to record the Easement Use Agreement.
