WHEREAS, the City has requested the County's assistance with Playground Improvements at McO rod Park in the City of Everglades City based on damage caused by Hurricane Irma in September 2017; and WHEREAS, the Community Foundation of Collier County through its Hurricane Irma Disaster Relief Fund has provided Collier County with grant funds in the amount of$15,000 for the City of Everglades City Swingset Replacement; and • WHEREAS,the County has committed to use the grant funds for the swing set replacement • and to resurface the existing basketball courts and tennis courts using County funds, NOW,THEREFORE, in consideration of the covenants contained herein,the City and the County hereby agree as follows: WITNESSETH in consideration of these premises,the sum of Ten Dollars ($10.00), and other good and valuable consideration, the receipt and sufficiency of which is hereby mutually acknowledged, it is agreed by and between the parties as follows: 1. This Agreement is entered into pursuant to the provisions of the Florida Interlocal Cooperation Act of 1969,set forth in§163.01,et seq.,Fla.Stat.,and is further authorized pursuant to the parties' respective home rule powers granted by the Florida Constitution. 2. Records: The City shall maintain records, books, documents, papers and financial information pertaining to work performed under this Agreement for a period of three(3) years, in compliance with Chapter 119, the Florida Public Records Law, The City agrees that the County, or any of its duly authorized representatives,shall,until the expiration of three(3)years after final payment under this Agreement, have access to, and the right to examine and photocopy any pertinent books, documents,papers, and records of the City involving any transactions related to this Agreement. 8.
