Thank you l683 FIRST AMENDMENT TO GRANT AGREEMENT BETWEEN CRA AND GRANTEE FOR COMMERCIAL BUILDING IMPROVEMENTS FOR BAYSHORE GATEWAY TRIANGLE COMMUNITY REDEVELOPMENT AREA THIS FIRST AMENDMENT ("Amendment"), entered into this day of , 2019, by and between Collier County Community Redevelopment Agency(hereinafter referred to as"CRA") a d Naples 2.0 LLC (hereinafter referred to as"Grantee"). RECITALS: WHEREAS, CRA and Grantee have previously entered into a Grant Agreement for Commercial Building Improvements for Bayshore Gateway Triangle Community Redevelopment Area, dated June 12, 2018, hereinafter referred to as the `Grant Agreement', attached hereto as Exhibit"A"; WHEREAS, the CRA and Grantee are desirous of amending the Grant Agreement to correct scrivener's errors in certain dates; and NOW, THEREFORE, in consideration of the covenants and agreements provided within the Grant Agreement,and Ten Dollars ($10.00)and other valuable consideration,the Parties agree as follows: 1. The foregoing Recitals are true and correct and are incorporated by reference herein; 2. All payments for approved projects must be in the form of a check or credit card drawing on funds from Grantee's accounts. All receipts and invoices must reconcile against payments. 3. Paragraph 8 is amended as follows: Within forty-five (45) days after confirmation that the improvements were constructed pursuant to the terms of the approved application, the Grantee shall be issued a check in the amount of the grant. However, if the Grantee fails to make the improvements pursuant to the terms of the approved application, or if the improvements are not completed by October 25, 201&June 11, 2019, the grant shall be deemed revoked and Grantee shall not be entitled to funding. 4. Except as expressly provided herein, the Grant Agreement remains in full force and effect according to the terms and conditions contained therein, and said terms and conditions are applicable hereto except as expressly provided otherwise herein.
