EXECUTIVE SUMMARY
Recommendation to approve one (1) mortgage satisfaction for ABLE Academy, a Community
Development Block Grant (CDBG) Loan in the amount of $515,000.
OBJECTIVE: To support low- and moderate-income persons of Collier County through public service
activities.
CONSIDERATIONS: The U.S. Department of Housing and Urban Development (HUD) offers
entitlement funds to allow local governments to meet program-specific community needs. Collier County
became an entitlement community and first received CDBG funds in 2001. Entitlement programs include
CDBG, which fund a wide variety of projects such as acquisition, public services, public amenities, and
rehabilitation.
The County awarded ABLE Academy an agreement on May 14, 2013 (Agenda Item #16D10). The
CDBG Agreement provided funds in the amount of $515,000 (the “CDBG Grant”) to be used for the
acquisition of real property located at 5860 Golden Gate Parkway, Naples, Florida 34116.The CDBG
Agreement, together with 24 CFR 570.505, requires the borrower to utilize and continue to use the
Property to meet one (1) of the national objectives for five (5) years. The five -year continued use period
expired on August 2, 2018. The County has determined that the borrower’s current use of the Property
which is set forth in the CDBG Agreement, complies with the required use.
The contingent obligations evidenced by the Note are secured by a CDBG First Mortgage which
corresponds with the five (5) year period set forth in the Agreement. Pursuant to the terms, i f no
triggering event occurs within the Term, the Note is null and void and unenforceable against the
borrower.
The subrecipient has met the required obligation and therefore it is recommended that the Mortgage be
satisfied.

FISCAL IMPACT: There is no Fiscal impact associated with the Satisfaction of Mortgage. The $10
recording fee will be paid by CDBG Grant Fund (705) Project 33580.
GROWTH MANAGEMENT IMPACT: There is no Growth Management impact.
LEGAL CONSIDERATIONS: This Item is approved for form and legality and requires a majority vote
