EXECUTIVE SUMMARY
Recommendation to approve three (3) amendments to declaration of restrictive covenants executed
by Youth Haven, Inc., to ensure compliance with 24 CFR 570.505.
OBJECTIVE: To comply with the requirements of U.S. Department of Housing and Urban
Development (HUD) grant programs .
CONSIDERATIONS: HUD provides Community Development Block Grant (CDBG) funds to address
program-specific needs in the community. In accordance with 24 CFR 570.505, property assisted with
CDBG funds must continue to meet a CDBG National Objective for a period of five (5) years. Within the
last five (5) years, Youth Haven Inc., has completed three (3) CDBG funded projects. The CDBG funded
projects facilitated improvements to the Youth Haven Campus located at 5867 Whitaker Road in Naples,
Florida 34112. All three (3) of these projects met a CDBG national objective by serving low and
moderate-income persons. To ensure compliance with the five-year period a Declarations of Restrictive
Covenants for each project was executed by Youth Haven and recorded in public records. Each recorded
declaration references the CDBG funding regulation and the Youth Haven property’s legal description.
The property lines for the Youth Haven Campus have been adjusted. A new land survey perfor med by
Rhodes and Rhodes Land Surveying, Inc., has created a new legal description for the campus property.
The recorded restrictive covenants associated with the three (3) CDBG funded projects must be amended
to correctly identify the campus property. The change to the property does not affect the campus buildings
or Youth Havens operations. Youth Haven will continue to serve low to moderate-income clients through
the end of the five-year periods.
One (1) amendment contains a correction for a typing error in the original declaration of restrictive
covenants.
FISCAL IMPACT: This action has no new Fiscal impact. The funding source for the grant awards are
the CDBG. The Youth Haven activity was budgeted in the Housing Grant Fund (705), CDBG project
33176, 33236, 33289, 33364, and 33434.
LEGAL CONSIDERATIONS: This Item has been approved as to form and legality and requires a
majority vote for Board approval. - JAB
GROWTH MANAGEMENT IMPACT: Acceptance and implementation of the amendments will
further the Goals, Objectives, and Policies of the Housing Element of the Growth Management Plan.
RECOMMENDATION: To approve and authorize the Chairman to sign three (3) amendments to
restrictive covenants.
