Resolution 2005-120 RESOLUTION NO. 2005 -120 A RESOLUTION BY THE BOARD OF COUNTY COMMISSIONERS, COLLIER COUNTY, FLORIDA, (I) REPEALING AND SUPERSEDING RESOLUTION NO. 2004-211, WHICH RESOLUTION APPROVED, AND AUTHORIZED THE CHAIRMAN TO SIGN, A LOCAL AGENCY PROGRAM AGREEMENT WITH THE STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION FOR THE PURCHASE AND INSTALLATION OF A PREFABRICATED PEDESTRIAN BRIDGE ON COUNTY ROAD 951 OVER THE GOLDEN GATE OUTFALL CANAL, AND (2) APPROVING, AND AUTHORIZING THE CHAIRMAN OF THE BOARD OF COUNTY COMMISSIONERS TO EXECUTE, A LOCAL AGENCY PROGRAM AGREEMENT WITH THE STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION FOR THE PURCHASE AND INSTALLATION OF TWO PREFABRICATED PEDESTRIAN BRIDGES ON GOLDEN GATE PARKWAY OVER THE SANTABARBARA CANAL. WHEREAS, by Resolution No. 2004-21 I, the Collier County Board of County Commissioners approved, and authorized its Chairman to execute, a Local Agency Program Agreement with the State of Florida Department of Transportation (FDOT), in which agreement FDOT agreed to reimburse Collier County up to the sum of $262,500 of the estimated $300,000 cost for the purchase and installation of a prefabricated bridge within the C.R. 951 right-of-way over the Golden Gate outfall canal; and WHEREAS, Parks and Recreation, which was to utilize these bridges for the purposes of a Greenway Project, is not ready at this time to comm~j]le this Project, and has accordingly released these funds; and WHEREAS, FDOT is willing to reallocate these funds by entering into a Local Agency Program Agreement ("Agreement") with Collier County, wherein FDOT will reimburse Collier County up to the sum of $262,500 for the purchase and installation of two prefabricated pedestrian bridges on Golden Gate Parkway over the Santa Barbara Canal; and WHEREAS, the Collier County Board of County Commissioners finds that it is in the public interest to install both of these pedestrian bridges, and that this Agreement is in the best interests of the citizens of Collier County. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that; 1. Resolution No. 2004-211 is hereby repealed and superseded by this Resolution. 2. The Board of County Commissioners approves, and authorizes its Chairman to sIgn, the attached Agreement. 3. A certified copy of this Resolution will be forwarded by the Collier County Clerk to FDOT along with the Agreement for execution by FDOT. . 4.
