RESOLUTION NO. 05. 118
RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY,
f'LORIDA TO AUTHORIZE FINAL ACCEPTANCE
OF TI10SE ROADW A Y AND DRAINAGE
IMPROVEMENTS IN BERKSHIRE PINES, PHASE
ONE, RELEASE OF THE MAINTENANCE
SECURITY, AND ACCEPT THE MAINTENANCE
RESPONSIBILITY FOR THE ROADWAY AND
DRAINAGE IMPROVEMENTS THAT ARE NOT
REQUIRED TO BE MAINTAINED BY THE
HOMEOWNER'S ASSOCIATION
WHEREAS, the Board of County Commissioners of Collier County, Florida, on
Deeemher 2, 1991 approved the plat of Berkshire Pines, Phase One for recording; and
WHEREAS, the Developer has constructed and maintained the roadway and
drainage improvements in accordance with the approved plans and specifications and as
ITl]uired by the Land Development Code (Collier County Ordinancc No. 91.102, as
amcndcd); and
WHEREAS, the Developcr is requesting final acceptance of the roadway and
drainage improvcmcnts and rcleasc of his maintenance security; and
WHEREAS, the Engineering Scrvices Section of the Devclopmcnt Serviccs
Department has inspcctcd the roadway and drainage improvcments, and is rccommcnding
acceptance of said facilities.
NOW, THEREFORE, BE 11' RESOLVED BY THE BOARD Of' COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that final acceptancc is hcrcby
grantcd for thosc roadway and drainage improvcments in Berkshire Pines, Phase Onc, and
authorize the Clerk to rclease the maintcnance security.
BE IT FURTHER RESOLVED AND ORDERED that the County accept the
future maintenance and other attendant costs for roadway and drainage improvemcnts that
arc not rel]uired to be maintained by the Berkshire Pines Homeowner's Association,
