Resolution 2005-076 16811 RESOLUTION NO. 2005 - 70 A RESOLUTION AUTHORIZING THE EXCHANGE OF PROPERTY PURSUANT TO SECTION 125.37, F.S. WHEREAS, in accordance with provisions of Section 125.37, Florida Statutes, whenever the Board of County Commissioners possesses any real property not needed for public purposes, said property may be exchanged for other real property, when doing so is in the best interest of the County; and WHEREAS, on June 22, 2004, the Board of County Commissioners approved and entered into an agreement with A. Grover Matheney, as Successor Trustee under that certain Land Trust Agreement dated June 29, 1988, and as Successor Trustee under that certain Land Trust Agreement dated June ro, 1998, Blend-All Hotel Development, Inc., Walden Avenue Blend-All Hotel Development, Inc., Dick Road Blend-All Hotel Development, Inc., and WR-I Associates, Ltd., (collectively "Blend-All") contemplating, among other things, the exchange of private property owned by Blend-All and needed for the expansion of Immokalee Road (see Exhibit "A" Parcels 1 through 5), in return for the transfer of a portion of former access road right-of-way (see Exhibit "B") from the County to Wal-Mart; and WHEREAS, said access road right-of-way is being transferred from the State Highway System to the jurisdiction of Collier County; and WHEREAS, a legal advertisement, as required by statute, has been published once a week for two weeks in a newspaper of general circulation, setting forth the terms and conditions of such property exchange; and NOW THEREFORE BE IT RESOLVED that the Collier County Board of County Commissioners does hereby authorize the conveyance of a portion of the former access road right-of-way being acquired from the Florida Department of Transportation and identified in Exhibit "B" to the abutting property owner in exchange for the transfer to Collier County of real property identified in Exhibit "A," and required for the expansion of Immokalee Road from four lanes to six lanes between USAl and Interstate 1-75. fI..- THIS RESOLUTION ADOPTED this 2'.5 day of jANVA~Y ,2005 after motion, second and riiij,iil,ntYY9te. ." 1~ f!!V14IJ& ,i, r.';""-'" ...:.....~,. 4!..."
