RESOLUTION NO. 2005- 25
A RESOLUTION REQUESTING THAT THE FLORIDA DEPARTMENT OF
TRANSPORTATION TRANSFER TITLE TO CERTAIN RIGHTS-OF-WAY TO
COLLIER COUNTY.
WHEREAS, in accordance with provisions of Section 335.0415, Florida Statutes,
the State of Florida Department of Transp0l1ation (hereinafter refelTed to as "FDOT") has
the authority to transfer jurisdiction of roads and rights-of-way from the State Highway
System to local govemmental entities, provided there is mutual approval of the transfer
by FDOT and the affected local government entity; and
WHEREAS, FDOT currently has title to the right-of-way required for the
construction of two Access Roads, one located in the Southwest quadrant of Interstate 1-
75 and Immokalee Road (CR-846), and one located in the Southeast quadrant of
Interstate 1-75 and Immokalee Road (CR-846); and
WHEREAS, FDOT desires to transfer said access road right-of-way from the
State Highway System to the jurisdiction of Collier County; and
WHEREAS, Collier County desires for the FDOT to transfer jurisdiction of said
access road right-of-way from the State Highway System to the jurisdiction of Collier
County; and
WHEREAS, the Collier County Board of County Commissioners has determined
that is in the best interest of the citizens of Collier County for the County to accept title to
said access road right-of-way and the jurisdiction therefor.
NOW THEREFORE BE IT RESOLVED that the Collier County Board of
County Commissioners docs hereby request the Florida Depm1ment of Transportation to
transfer unto Collier County jurisdiction for, and all right, title and interest in and to that
certain access road right-of-way described in Exhibit "A" (attached hereto and
incorporated herein by reference) and does hereby authorize its Chairman to execute any
'Igreement or other instrument pertaining to said transfer.

second and majority vote.
