OBJECTIVE: To receive approval to sell alcoholic beverages (beer & wine) at the Bayshore Cultural Festival of the Arts event on January 23, 2010 on CRA owned parcels. CONSIDERATIONS: On July 28, 2009, the CRA Board approved agenda item 16G4 allowing the Bayshore Gateway Triangle CRA staff to host the Bayshore Cultural Festival of the Arts event. The cvent date is January 23, 2010 and will be held on two CRA owned vacant parcels abutting Bayshore Drive; FOLIOs: 61840960103 & 61840960006. See attached site map. On the BCC/CRA December 15, 2009 agenda is a recommendation to approve a CRA Event Policy and Procedures Manual to govem CRA event. operations. This Manual has becn crafted from the Collier Parks and Recreation Event and Fee Policy (BCC Resolution 2008-283). In that policy are strict guidelines governing alcohol sales operations and liability insurance requirements of $500,000. If approved, this event's conduct and alcohol sales will comply with the Policy and Procedures and additionally insure the County and CRA. East Naples Kiwanis Club offered to serve as the alcohol beverage vendor for the event. They will staff and monitor the operation to include alcohol sales and age-identification services. They will acquire their alcohol sales permit from Alcohol, Tobacco and Fircarms (ATF), Zoning Dcpartment approval, and insurance through Kiwanis Intemational. Attached as back-up is the East Naples Kiwanis letter outlining their mission and how the net proceeds will be used. Security and safety issues have been coordinated with the Collier Sheriff's Office, Fire Department and Collier Emergency Management Service. Precautionary measures have been taken to contain the sale and consumption of alcohol on site, and an "alcohol exclusion area" in and around the children's play area will be maintained and monitored. FISCAL IMPACT: There are no eRA expenses associated with this request. A Zoning event permit fee was included in the event budget. 10% of the Kiwanis net procceds will be donated to the CRA for future events of which will be deposited into the CRA revenue account with the Clerk's Finance Department. GROWTH MANAGEMENT IMPACT: There is no f,'l'owth management plan impact associated with this event. LEGAL CONSIDERATIONS: The provision of alcoholic beverages at a County-approved event on CRA properly exposes the County to liability in the event of an accident or injury if the insurance is not sufficient to cover the cost oflitigation and any liability. This is ultimately a business decision. Agenda Item No. 1685 December 15. 2009 Page 5 of 5 We will utilize the services of Budweiser DBA coastal Beverage for the Beer wagon and will serve Budweiser and Bud lite draft beer We will purchase wine from ABC liquors and soda and water Are still in question We will have a table in front ofthe trailer or truck and Have a Standard Venue tabletop booth presentation We have agreed on a portion of the revenue to be committed to The CRA to support future events We expect the beer to sell for either $2.00 or $3.00[12 oz or 16 oz serve size] We expect 4 oz wine to sell for $4.00 And optional soft drinks $1.OO-$2.00ea Kiwanis International will insure us at the event through the Hylant Group Indianapolis In 46280-0925 And additionally Named Insurance will cover the Board of county commissioners and The eRA We will apply to the division of Alcohol Tax and firearms in Ft Myers t1, for our 3 day special event Alcohol permit .This is not allowed to Permit until January 4,2010 according to ATF spokesperson, who states that their computers are on a calendar year only system. We will take that permit To Collier County zoning for their stamp of approval.
