Agenda 12/15/2009 Item #16D 7 Agenda Item No. 1607 December 15, 2009 Page 1 of 10 EXECUTIVE SUMMAHY Recommendation to repeal Resolution No. 2007-190 and Adopt the Attached Revised Resolution No. 2010-_ that Lists New Fines and Fces for Colller County Public Library. (Estimated Fiscal Impact of $350,000 annually for all Library Fincs and Fces.) OBJECTIVE: To repeal Resolution No. 2007-190 that lists the Library Fines and Fees, and adopt the attached resolution. CONSIDERATIONS: Library fines and fees were last modi lied in July 2007. Since then various changes have occurred, including the addition of new public meeting rooms, the library no longer circulates juvenile filmstrips, a fee for computer use by non-residents is recommended. The Library Advisory Board recommends the following changes to the Fines and Fees schedule: - . Eliminate juvenile filmsllip circulation policies and overdue fees. o The filmstrips are no longer used and have been replaced by DVDs. . Add a charge of $5.00 per 30-minute use of public computers for non-residents. o The charge for computer usage applies only to non-residents who elect not to purchase a non-resident library card. In order to use the public computers, Library Staff must individually register these people 10 ensure equal access for all library users to the public computers. The fee will offset the higher cost of managing those who do not have library cards. . Charges lor use of library meeting rooms as listed on Resolution No. 2010-_. o Additional public-use meeting rooms are available at the newly constructed Golden Gate and South Regional Libraries, and will be available at Marco Island when Rose Hall is completed. Rental of computer labs and other facilities were also added to the fee schedule. The Library Advisory Board has reviewed and recommends approval of this fee schedule. FISCAL IMPACT: Approval of the revised Fines and Fees Schedule should have a positive impact on the FY2010 General Fund Budget of the Collier County Public Library. Anticipated revenue from all Library Fines and Fees should net approximately $350,000 in the FY2010 General Fund Budget. GHOWTH MANAGEMENT IMPACT: None. LEGAL CONSIDERATIONS: This item has been reviewed by the ('ounty Attomey's Office and is legally sufficient for Board action. CMG. WHEREAS, on September 13, 1988, the Board of County Commissioners (Board) adopted Ordinance No. 88-71, as subsequently amended, confirming the creation of the Library Advisory Board to the act on behalf of the Board in the establishment of policies relating to the Collier County Library Department; and WHEREAS, Ordinance No. 88-71, as amended, also provides that the Library Advisory Board will advise the Board on all Library Department issues including fees, budgets, capital planning, staffing levels, and other library related programs and shaH furnish budget recommendations for each forthcoming fiscal year for the operation of the County's library system; and WHEREAS, the Library Director has prepared an annual library budget in accordance with recommendations from the Library Advisory Board which includes revisions to library fees and fines to reflect current economic conditions; and WHEREAS, Collier County Library fines and fees are currently enumerated In Resolution No. 2007-190 adopted on July 24, 2007; and WHEREAS, the Library Advisory Board is recommending that the Board adopt revised library fees and fines consistent with the proposed budget. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that: 1. The following fines and fees schedule is approved: a. The overdue fine for adult print materials is 25 cents ($ 0.25) per item per day overdue, with the exception of a 10-cent ($0.10) per item per day overdue charge for adult paperback books and a $1 per item per hour overdue charge for Reference books. b. The overdue fine for children's print and audiovisual materials is 10 cents ($ 0.10) per item per day overdue, with the exception of videocassettes and DVDs, with an overdue fee of $1 per item per day overdue. c. The maxinlUm tine per overdue item is $10.00 for items except children's materials, adult paperbacks and periodicals for which the maximum fine is $5; and the maximum fine for Reference books is $25. d. The overdue fine for adult audio and CD-ROM materials is 25 cents ($0.25) per item per day overdue. e. The fee for a replacement or damaged library card is one dollar ($1.00). g. The fee for replacement processing is three dollars ($3.00) per item. h. The fee for a lost or damaged film borrowed from the State Library shall be from one hundred twenty-five dollars ($125) up to fifteen hundred dollars ($1500), and shall be the actual cost to repair or replace the item as detennined by the State Library. i. The fee charged for a photocopy or laser printer output is ten cents ($0.10) per page. j. The fee charged for a microfilm printout is twenty-five cents ($0.25) per page. k. The fee charged to repair or replace damaged media boxes, bags, or book covers is one dollar ($1.00) per item. 1. The fee for non-resident library cards is ten dollars ($10.00) per month, fifty dollars ($50.00) per six month, and one hundred dollars ($100.00) per year. m. Library service shall be summarily denied to every patron owing ten dollars ($10.00) or more in fines andlor or fees. (Reinstatement upon full payment.) n. Use of public Intemet Computers without a library card shall be five dollars ($5.00) per 30 minute session. 2. Library meeting facilities can be scheduled for non-library sponsored events and meetings. The following charges are required for all such users of the described facility: a. Non-Profit Groups: i. Meeting room with no electronic equipment: $10 per hour. 1. Includes Rees Meeting Room. South Regional Small Group Study and multi-purpose tueeting rooms at East Naples, Golden Gate, Estates Branch and Immokalee. ii. Meeting room with microphone and speakers: $15 per hour. 1. Includes Rees Meeting Room. iii. Meeting room with projector, microphone and speakers; $25 per hour. I. Includes Rees Meeting Room. iv. Sugden Theater (HQ) includes microphone and spcakers: $75 per hour. v. Sugden Theater (HQ) with projector: $90 per hour. vi. Estates and Golden Gate Branch Computer Labs: $50 per hour. 1.
