Agenda 01/08/2019 Item #16B 101/08/2019 EXECUTIVE SUMMARY Recommendation to authorize a reimbursement payment to Celebration Food Truck Park / Naples 2.0 LLC in the amount of $10,000 for work performed by Acadian Builders, 4573 Exchange Avenue #4, Naples Florida 34104 to relocate the existing Bayshore Beautification MSTU irrigation pump located within the Bayshore Beautification MSTU easement. OBJECTIVE: To reimburse Celebration Food Truck Court / Naples 2.0 LLC in the amount of $10,000.00 for costs associated with relocating the existing irrigation pump that serves the Bayshore Beautification MSTU landscaping along Bayshore Drive in the Bayshore Gateway Triangle Community Redevelopment Area. The relocation was necessary to allow the new Celebration Food Truck Park the ability to finalize the site development plans and begin construction of the new establishment. CONSIDERATION: Celebration Food Truck Park / Naples 2.0 LLC submitted a site development plan on January 23, 2017, to Collier County Growth Management Department. Based on site design, it was determined that the existing Bayshore Beautification Municipal Service Taxing Unit (MSTU) irrigation pump was located within the proposed pedestrian access point on the site plans. The existing irrigation pump was located on the Celebration Food Truck Park / Naples 2.0 LLC property and original plans did not reflect that it was located within a Collier County Easement. The Architect of Record, David Corban, requested assistance from the MSTU to relocate the irrigation pump. On May 3, 2017, and August 2, 2017, the MSTU Advisory Board reviewed the site plan and Architect of Record request to relocate the irrigation pump. The Architect of Record, Mr. Corban, anticipated that the project would commence construction as soon as the final building plans were approved. MSTU staff requested estimates from outside engineering firms and contractors to relocate the irrigation pump prior the commencement of work by Acadian Builders. However, due to lack of responses from outside vendors and timing issues, MSTU Staff determined that the most cost-effective approach would be for Acadian Builders to coordinate and perform the necessary work to relocate the pump, and then reimburse Celebration Food Truck Park / Naples 2.0 LLC once the work was completed. Upon further investigation, it was determined that the existing irrigation pump was in a recorded easement. On May 2, 2018, the MSTU Advisory Board reviewed a proposal from Acadian Builders to relocate the pump and requested that staff continue to negot iate the terms and price to do so. Due to its location, it was determined that the pump would require a newly recorded easement, and that reimbursement of the relocation pump would not take place until after the easement was recorded. The new easement was recorded on September 14, 2018. Celebration Food Truck Park / Naples 2.0 LLC has provided the Bayshore MSTU with the new recorded Collier County public utility easement and the approved/final “as built” drawings outlining the location of the irrigation pump and irrigation lines that serve the MSTU. The work has since been completed and the contractor has been paid. MSTU staff is requesting a reimbursement payment to Celebration Food Truck Park / Naples 2.0 LLC. The property owner understood that the Boar d of County Commissioners will make the final determination of approval of payment. ADVISORY BOARD RECOMMENDATION: The Bayshore Beautification MSTU Advisory Board voted 5-0 on May 2, 2018, to authorize the reimbursement payment up to $13,159.00 to pay for the relocation of the irrigation pump. FISCAL IMPACT: Funding for the reimbursement is available in Fund 163, Bayshore Beautification MSTU. 16.B.1 Packet Pg. 1068 01/08/2019 GROWTH MANAGEMENT IMPACT: This project meets the current Growth Management Plan standards to ensure the adequacy and availability of viable public facilities.
